Bharat Update News<\/figcaption><\/figure>\n<ul>\n<li><strong>Article 371(K)<\/strong> is a <strong>proposed constitutional provision for Ladakh.<\/strong><\/li>\n<li>It is <strong>intended to<\/strong> provide a <strong>directly elected Union Territory-level legislative body <\/strong>along <strong>with special safeguards.<\/strong><\/li>\n<li><strong data-start=\"114\" data-end=\"130\">Proposed by:<\/strong> The <strong data-start=\"135\" data-end=\"175\">Union Ministry of Home Affairs (MHA)<\/strong> proposed this framework during talks with Ladakh representatives, including the <strong data-start=\"256\" data-end=\"304\" data-is-only-node=\"\">Leh Apex Body and Kargil Democratic Alliance<\/strong>.<\/li>\n<li><strong>Origin:<\/strong>\n<ul>\n<li><strong>2019 Reorganisation:<\/strong> Ladakh became a separate Union Territory without a legislative assembly after the <strong>reorganisation of Jammu and Kashmir in 2019.<\/strong><\/li>\n<li><strong>Demand for Safeguards:<\/strong> Concerns over land, employment, demography, cultural identity and limited Hill Council powers led to <strong>demands for stronger constitutional protection.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Key Features of the Proposal:<\/strong>\n<ul>\n<li><strong>Directly Elected Body:<\/strong> Ladakh would have a <strong>directly elected governing body at the Union Territory level.<\/strong><\/li>\n<li><strong>Legislative Powers:<\/strong> The body would have <strong>powers over land, culture and language, forests, environment and natural resources.<\/strong><\/li>\n<li><strong>Separate Arrangement:<\/strong> Article 371(K) would <strong>create a separate constitutional arrangement for Ladakh, rather than simply extending the Sixth Schedule.<\/strong><\/li>\n<li><strong>Unresolved Powers:<\/strong> The <strong>Executive, financial, planning, police and law-and-order powers<\/strong> have <strong>not yet been decided.<\/strong>\n<ul>\n<li>There is <strong>no detailed draft<\/strong> specifying the powers of the proposed body, and <strong>further talks are expected in October.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Difference Between Article 371(K) and Sixth Schedule:<\/strong>The Sixth Schedule <strong>creates Autonomous District Councils within States<\/strong><em data-start=\"203\" data-end=\"244\">(Assam, Meghalaya, Mizoram and Tripura)<\/em>..\n<ul>\n<li>In contrast, <strong>Article 371(K) proposes a directly elected governing body for Ladakh, a Union Territory<\/strong>, creating a distinct constitutional arrangement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 class=\"yellow-h2-box\">About Article 371<\/h2>\n<ul>\n<li><strong>Special Provisions:<\/strong> Articles <strong>371 to 371-J provide special constitutional arrangements for 12 States<\/strong>.<\/li>\n<li data-start=\"1285\" data-end=\"1421\"><strong data-start=\"1287\" data-end=\"1310\">Original provision:<\/strong> <strong data-start=\"1311\" data-end=\"1364\">Article 371 was part of the original Constitution<\/strong> and provided special arrangements for certain regions.<\/li>\n<li data-start=\"1422\" data-end=\"1562\" data-is-last-node=\"\"><strong data-start=\"1424\" data-end=\"1444\">Later additions:<\/strong> <strong data-start=\"1445\" data-end=\"1489\">Articles 371-A to 371-J were added later<\/strong> through <strong>constitutional amendments under<\/strong>.<\/li>\n<li><strong>States Covered:<\/strong> The 12 States are <strong>Maharashtra, Gujarat, Nagaland, Assam, Manipur, Andhra Pradesh, Telangana, Sikkim, Mizoram, Arunachal Pradesh, Goa and Karnataka.<\/strong><\/li>\n<li><strong>Different Safeguards:<\/strong> These provisions <strong>vary from state to state<\/strong> and provide <strong>safeguards relating to local political, cultural, social or economic interests.<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The Centre has proposed Article 371(K) to provide Ladakh with constitutional safeguards and a directly elected governing body.
