To address these issues, the <strong>Department of Consumer Affairs<\/strong> has amended the <strong>Consumer Protection (E-Commerce) Rules, 2020<\/strong> through the <strong>Consumer Protection (E-Commerce) (Amendment) Rules, 2026<\/strong>. The new rules will come into force on <strong>January 1, 2027<\/strong>.<\/p>\n<h2 class=\"yellow-h2-box\"><strong>Key Amendments<\/strong><\/h2>\n<ol>\n<li><strong> Greater Price Transparency: <\/strong>Whenever a price reduction is announced, platforms must display both the reduced price and the <strong>prior price<\/strong>, defined as the lowest price at which the product was offered during the preceding <strong>30 days<\/strong>.<\/li>\n<li><strong> Fair Search Results: <\/strong>E-commerce platforms cannot manipulate search results in a manner that <strong>misleads consumers or reduces the relevance of results<\/strong> to their search query.<\/li>\n<li><strong> Clear Disclosure of Sponsored Listings: <\/strong>Paid or sponsored products must be identified through <strong>clear and prominent disclosures<\/strong>, enabling consumers to distinguish advertisements from genuine search results.<\/li>\n<li><strong> Regulation of Dark Patterns: <\/strong>Platforms must comply with the <strong>2023 Guidelines on Prevention and Regulation of Dark Patterns<\/strong>, conduct a <strong>yearly self-audit<\/strong> and prominently display a certificate of compliance. Dark patterns include false urgency, basket sneaking, subscription traps, drip pricing and disguised advertisements.<\/li>\n<li><strong> Strengthened Consumer Grievance Redressal: <\/strong>Every e-commerce entity must provide the complainant with a <strong>copy of the complaint recorded by its grievance officer<\/strong>.<\/li>\n<li><strong> Integration with National Consumer Helpline: <\/strong>Every e-commerce entity must become a partner in the convergence process of the <strong>National Consumer Helpline (NCH)<\/strong>. This is significant as <strong>5,11,196 out of 17,71,622 NCH grievances in 2025 were related to e-commerce<\/strong>, accounting for around <strong>29%<\/strong>.<\/li>\n<li><strong> Better Seller and Product Information: <\/strong>Platforms must provide information such as <strong>best-before\/use-before dates, return and refund policies, warranty, delivery and payment details<\/strong>, enabling informed purchasing decisions.<\/li>\n<li><strong> Protection of Consumer Information: <\/strong>Consumer information cannot be used for specified purposes without <strong>express and affirmative consent<\/strong>.<\/li>\n<li><strong> Regulation of Bundled Fees: <\/strong>Platforms cannot impose <strong>bundled fees for services unrelated to the e-commerce platform<\/strong>, except for the specified loyalty or membership programme provision.<\/li>\n<li><strong> Disclosure for Imported Goods: <\/strong>For imported products, platforms must disclose the <strong>importer\u2019s details and country of origin<\/strong>.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Significance<\/strong><\/h2>\n<ol>\n<li><strong> Protects Consumer Interests: <\/strong>The amendments seek to protect consumers from <strong>misleading practices, hidden costs and manipulative digital interfaces<\/strong>.<\/li>\n<li><strong> Promotes Transparency: <\/strong>Price, search rankings, sponsored listings and product information become more transparent, helping consumers make <strong>informed choices<\/strong>.<\/li>\n<li><strong> Strengthens Accountability: <\/strong>Self-audits, grievance documentation and integration with the NCH increase the <strong>accountability of e-commerce entities<\/strong>.<\/li>\n<li><strong> Balances Regulation and Ease of Doing Business: <\/strong>The rules aim to create a <strong>transparent and balanced regulatory framework<\/strong> without imposing unnecessary regulatory burdens on businesses.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Potential Impact<\/strong><\/h2>\n<ol>\n<li><strong> Greater Consumer Empowerment:<\/strong> Consumers will be able to make <strong>better-informed purchasing decisions<\/strong> because of clearer information on prices, sellers, products and advertisements.<\/li>\n<li><strong> Reduction in Misleading Practices:<\/strong> Regulation of <strong>fake discounts, dark patterns, manipulated search rankings and hidden charges<\/strong> can reduce unfair trade practices.<\/li>\n<li><strong> Stronger Accountability:<\/strong> Mandatory complaint records, annual self-audits and NCH integration will make platforms <strong>more accountable to consumers<\/strong>.<\/li>\n<li><strong> Better Data Protection:<\/strong> The requirement of <strong>affirmative consent<\/strong> can provide consumers greater control over the commercial use of their information.<\/li>\n<li><strong> Improved Trust in E-Commerce:<\/strong> Greater transparency can increase <strong>consumer confidence and trust<\/strong> in digital marketplaces.<\/li>\n<li><strong> Level Playing Field for Businesses:<\/strong> Common disclosure and transparency requirements can create a <strong>more balanced regulatory environment<\/strong> for businesses operating in the digital marketplace.<\/li>\n<li><strong> Compliance Burden on Platforms:<\/strong> At the same time, e-commerce entities may face <strong>additional compliance, auditing and disclosure requirements<\/strong>, particularly smaller businesses and platforms<\/li>\n<\/ol>\n<p><strong>Conclusion:<\/strong> The <strong>2026 amendments<\/strong> strengthen the existing consumer-protection framework in response to evolving digital business practices.
