This has created new concerns regarding <strong>child safety, psychological well-being and regulatory accountability<\/strong>.<\/p>\n<h2 class=\"yellow-h2-box\"><strong>About AI chatbots <\/strong><\/h2>\n<ol>\n<li>AI chatbots use AI models <strong>to interpret natural language, maintain context and generate responses. <\/strong><\/li>\n<li>They can handle a<strong> wider variety of questions and conversations. <\/strong><\/li>\n<li>Well-known examples<strong> include ChatGPT and Claude, <\/strong>which allow users to ask open-ended questions and receive conversational responses.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Emerging concerns<\/strong><\/h2>\n<ol>\n<li><strong>Emotional dependence:<\/strong> Prolonged interaction with AI companions may create emotional dependence among children.<\/li>\n<li><strong>Psychological manipulation:<\/strong> Algorithmic responses may influence vulnerable children in harmful ways.<\/li>\n<li><strong>Harmful advice:<\/strong> AI interactions may expose children to inappropriate or dangerous advice.<\/li>\n<li><strong>Difficulty in detecting harm:<\/strong> Unlike conventional cybercrime, psychological harm may develop gradually through thousands of seemingly harmless interactions.<\/li>\n<li><strong>Platform accountability:<\/strong> The products of technology companies are becoming deeply embedded in children&#8217;s emotional lives, raising questions about their responsibility when harm occurs.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Regulatory gaps in India<\/strong><\/h2>\n<ol>\n<li>India&#8217;s existing laws, including the <strong>Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and Protection of Children from Sexual Offences Act, 2012<\/strong>, address important aspects of digital safety but do not provide a <strong>comprehensive framework for psychological risks from AI companions<\/strong>.<\/li>\n<li>Existing cybercrime mechanisms may not be adequately equipped to examine <strong>algorithmic behaviour and chatbot interactions<\/strong> as evidence.<\/li>\n<li>Therefore, accountability for AI-related psychological harm remains an emerging challenge.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Constitutional and regulatory concerns<\/strong><\/h2>\n<ol>\n<li><strong>Article 21<\/strong> guarantees the <strong>right to life and personal liberty,<\/strong> giving renewed significance to protecting children&#8217;s safety in the digital environment.<\/li>\n<li><strong>Article 39(f)<\/strong> emphasises conditions in which children can develop with <strong>freedom and dignity<\/strong> and are protected against exploitation.<\/li>\n<li>Therefore, child safety must extend beyond physical safety and personal-data protection to include <strong>emotional and psychological safety<\/strong>.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>Way forward<\/strong><\/h2>\n<ol>\n<li>India should establish <strong>age-appropriate safeguards<\/strong> for AI companions.<\/li>\n<li>There should be <strong>crisis-response mechanisms and independent safety assessments<\/strong>.<\/li>\n<li>Effective <strong>parental oversight<\/strong> should be encouraged while respecting children&#8217;s privacy and evolving autonomy.<\/li>\n<li>Cybercrime agencies should be equipped to examine <strong>algorithmic behaviour and chatbot interactions<\/strong>.<\/li>\n<li>California&#8217;s <strong>Senate Bill 1119 (\u201cAdam&#8217;s Law\u201d)<\/strong>, enacted in 2026, provides safeguards such as <strong>crisis-detection protocols, parental controls, notifications regarding disabled safety settings and independent safety audits<\/strong>. India can examine such developments but should develop a framework suited to its <strong>own institutional capacity and digital realities<\/strong>.<\/li>\n<li>Platforms should have clear <strong>accountability mechanisms<\/strong> when prolonged AI interaction causes harm.<\/li>\n<li>Regulation should remain <strong>balanced<\/strong>, as excessive restrictions could discourage innovation and burden emerging enterprises.<\/li>\n<\/ol>\n<p><strong>Conclusion: <\/strong>The objective should not be to prevent children from using AI but to ensure that <strong>technological progress is accompanied by accountability, safety and protection of children&#8217;s dignity and well-being<\/strong>.
