{"id":39568,"date":"2018-12-28T17:39:40","date_gmt":"2018-12-28T12:09:40","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=39568"},"modified":"2018-12-28T17:39:40","modified_gmt":"2018-12-28T12:09:40","slug":"amid-protests-triple-talaq-bill-passed","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/amid-protests-triple-talaq-bill-passed\/","title":{"rendered":"Amid protests, triple talaq Bill passed"},"content":{"rendered":"<p><a href=\"https:\/\/www.thehindu.com\/todays-paper\/amid-protests-triple-talaq-bill-passed\/article25845467.ece\">Amid protests, triple talaq Bill passed<\/a><\/p>\n<p><strong>News:<\/strong><\/p>\n<p>The Bill to the practice of triple talaq among Muslims a penal offence passed in Lok Sabha<\/p>\n<p><strong>Important Facts:<\/strong><\/p>\n<p><strong>Need for the bill<\/strong><\/p>\n<ul>\n<li>Despite the SC judgement in August 2017 which has made the practice of talaq-e-biddat illegal in India and striking down the practice of talaq-e-biddat (instant triple talaq) as unconstitutional, men has been divorcing their wives through triple talaq.<\/li>\n<li>201 cases of triple talaq were reported between the period of January 2017 and September 2018.<\/li>\n<\/ul>\n<p><strong>Key Features of the Bill<\/strong><\/p>\n<ul>\n<li>The aim of the bill is to protect the rights of married Muslim women.<\/li>\n<li>According to the Bill, giving instant triple talaq or \u2018talaq-e-biddat\u2019 will be illegal and void and will attract a jail term of three years for the husband.<\/li>\n<li>The proposed law makes instant triple talaq a \u201cnon-bailable\u201d offence. However, an accused can approach a magistrate even before trial to seek bail.<\/li>\n<li>Note: In a non-bailable offence, bail cannot be granted by police at the police station itself.<\/li>\n<li>A provision has been added to allow the magistrate to grant bail \u201cafter hearing the wife\u201d.The magistrate would ensure that bail is granted only after the husband agrees to grant compensation to the wife as provided in the bill.<\/li>\n<li>The offence of instant triple talaq will be \u201ccompoundable\u201d.
