Discuss the way forward."},"content":{"rendered":"\n<table class=\"wp-block-table\"><tbody><tr><td><strong>Demand of the question<\/strong> <br><strong>Introduction. <\/strong>Contextual Introduction. <br><strong>Body. <\/strong>Write both positive and negative effects of caste based reservation system. <br><strong>Conclusion. <\/strong>Way forward. <\/td><\/tr><\/tbody><\/table>\n\n\n\n<p>Reservation in Indian law is a form of affirmative action whereby a percentage of seats are reserved in the public sector units, union and state civil services, union and state government departments and in all public and private educational institutions for the socially and educationally backward communities and the Scheduled Castes and Tribes who are inadequately represented in these services and institutions. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Arguments that favour caste based reservation:<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Equal Opportunities and\nrespect<\/strong><strong>&#8211; <\/strong>The\nunderlying theory for the reservation by the state is the under-representation\nof the identifiable groups as a legacy of the Indian caste system. The framers\nof the Constitution believed that, due to the caste system, SCs and the STs\nwere historically oppressed and denied respect and equal opportunity in Indian\nsociety and were thus under-represented in nation-building activities.<\/li><li><strong>Oppression on weaker sections of\nthe society<\/strong><strong>&#8211; <\/strong>The\noppression of the weaker section of society (Including lower and backward\ncastes and tribes) by the stronger (upper castes) section has not ended. In\nfact, it has been aggravated. A new era of social justice and equality still\nremains a dream to be achieved. The benefits of development have been\nappropriated by about 20 per cent of the population at the top.<\/li><li><strong>Social Justice<\/strong><strong>&#8211; <\/strong>It establishes a new social order that would secure\nto the underprivileged sectors of our society justice in social relations and\nequality of opportunity to rise in society.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Arguments against the caste based reservation:<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Increased Casteism<\/strong><strong>&#8211; <\/strong>Casteism has been granted a fresh lease of life. Our\ncountry is already divided into various groups. Reservation will further divide\nthe population artificially. Earlier, reservations were accepted under special\nconditions for a period of fifteen years only, but continuing them forever will\nproduce vested interests and separatism, and will lead to a caste-war and the\ndisintegration of the country.<\/li><li><strong>Reduced meritocracy-<\/strong><strong> <\/strong>Merit and calibre have been replaced by mediocrity.\nReservation policy has generated a spirit of self-denigration, each caste and\ncommunity competing to be more backward than others.<\/li><li><strong>Breach of 50% limit-<\/strong><strong> <\/strong>The Supreme Court ruled that reservations cannot\nexceed 50% and put a cap on reservations. The central government of India\nreserves 27% of higher education, and individual states may legislate further\nreservations. Reservation in most states is at 50%, but certain Indian states\nlike Rajasthan have proposed a 68% reservation that includes a 14% reservation\nfor forward castes in services and education. However, there are states laws\nthat exceed this 50% limit. For example, the caste-based reservation fraction\nstands at 69% and is applicable to about 87% of the population in the state of\nTamil Nadu.<\/li><li><strong>Vote bank politics-<\/strong><strong> <\/strong>Attempts to include more and more castes\/classes in\nthe list of OBCs, have changed the social and economic landscape beyond\nrecognition.<\/li><li><strong>Increased conflicts-<\/strong><strong> <\/strong>In some states for anti-reservation agitation have\nincreased violence in the society. There is increase in discontent among people\nof advanced castes. The seventies, the eighties and the first six years of the\nnineties witnessed countrywide waves of violent protests.<\/li><li><strong>Impact on administrative\nefficiency-<\/strong><strong> <\/strong>This\nnot only politicised the civil services but also affected the efficiency of the\nadministration. Most of the officers are now working on the basis of caste and\ncreed.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Way forward<\/strong><\/h3>\n\n\n\n<p>Reservations should be accompanied by structural changes like land reforms\nand an inclusive educational support systems. The demands for special\nconcessions and privileges to the under\u00adprivileged are matters of right and not\nof charity or philanthropy. All the commissions and the committees that have\nexamined this issue like the <strong>Kelkar Commission <\/strong>have accepted the need\nfor compensatory discrimination to a certain limit. Reservation policy <strong>should\nbe reviewed every five years <\/strong>so that the state can rectify distortions and\npeople both backward and non-backward. The poor should get special weightage\nbut a <strong>watchdog body <\/strong>should keep an eye on their progress. As soon as it\nis found that they no longer need the crutches of reservations, all jobs should\nbe declared open to all.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Demand of the question Introduction.
