{"id":50400,"date":"2019-07-22T19:00:41","date_gmt":"2019-07-22T13:30:41","guid":{"rendered":"https:\/\/blogadmin.forumias.com\/?p=50400"},"modified":"2019-07-22T18:02:19","modified_gmt":"2019-07-22T12:32:19","slug":"7-pm-wto-struggling-to-stay-relevant-22nd-july-2019","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/7-pm-wto-struggling-to-stay-relevant-22nd-july-2019\/","title":{"rendered":"7 PM | WTO struggling to stay relevant | 22nd July, 2019"},"content":{"rendered":"\n<p><strong>Context: <\/strong>WTO\nlogjam and its impact on world economy.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Established in 1995\nand based in Geneva, Switzerland, the World Trade Organization (WTO) is the\nsuccessor to the&nbsp;General Agreement on Tariffs and Trade (GATT), an\norganization founded in 1948 whose rules created the modern multilateral\ntrading system. <\/li><li>The WTO is\nresponsible for overseeing the rules of international trade. It facilitates trade\nnegotiations among its members, which have increased from 123 in 1994 to 164 in\n2018<\/li><li>WTO decision-making\nhappens at the Ministerial Conference, generally held every two years. There\nhave been eleven such ministerials since the inaugural conference in Singapore\nin 1996. With a few exceptions, agreements reached at these conferences are\nmade by consensus, meaning that all members must agree, and decisions are\nbinding.<\/li><\/ul>\n\n\n\n<p><strong>USA and WTO issues related to trade:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Due to growing\ntrade deficit ($ 378.6 billion in 2018) of USA to China. To reduce the deficit\nUSA started to impose tariffs on china. U.S.\ntariffs on $200 billion in Chinese imports were recently increased to 25% from\n10%. <\/li><li>Trump also said the\nU.S. would begin the process of applying the 25% tariff to another $325 billion\nin imports that have been left alone so far.<\/li><li>To justify these\nactions, USA using the rule of General Agreement on Tariffs and Trade\n(GATT)-Article XXI. Under this article WTO\/GATT rules cannot prevent a country\nfrom taking any action if it considers necessary for the protection of its\nessential security interests.<\/li><li>Along with using\narticle-XXI, USA and its administration maintains that the WTO is incapable of\ndealing with trade disputes between nations. USA also starts accusing WTO\ndispute settlement system of \u201cjudicial overreach\u201d. <\/li><li>Since 2017, USA\nhas been blocking appointment of members to WTO dispute appellant board. This\nhas serious ramifications for the WTO dispute settlement system and countries\nloose starting trust on World trade order.<\/li><\/ul>\n\n\n\n<p><strong>WTO and dispute settlement mechanism:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>There are two main ways to settle a dispute once a complaint has been filed in the\u00a0WTO: <ul><li>The parties find a mutually agreed solution, particularly during the phase of bilateral consultations;<\/li><li>Through adjudication, including the subsequent implementation of the panel and Appellate Body reports, which are binding upon the parties once adopted by the\u00a0Dispute Settlement Board.<\/li><\/ul><\/li><li>If consultation fails, then the disputing nation goes to dispute settlement board. There are three main stages to the WTO dispute settlement process.<ul><li>consultations between the parties;<\/li><li>adjudication by panels and, if applicable, by the Appellate Body<\/li><li>The implementation of the ruling, which includes the possibility of countermeasures in the event of failure by the losing party to implement the ruling.<\/li><\/ul><\/li><li>According to WTO system, Appellate Body (AB) should have 7 members who are appointed by consensus among WTO members. Any appeal from the WTO dispute panel must be heard by three out of 7 members. These 7 members are appointed for 4 year term.<\/li><li>Once an Appellate Body member finishes his\/her term, a new member is required to appoint to keep the strength of the Appellate Board at seven.<\/li><li>Presently there are only 3 members left in the AB and if no new members are appointed, then by December 2019 there will be only one member left. This will make the AB dysfunctional and will jeopardize the settlement mechanism.<\/li><\/ul>\n\n\n\n<p><strong>WTO Dispute settlement system and its impact on\nIndia and World:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Skepticism:\nleast developed countries (LDC) and developing countries skeptical towards from\nthe starting days of WTO establishment and onwards its negotiations (DOHA round\ntalks). Present crisis in WTO dispute settlement board further aggravates the\nsituation.<\/li><li>Financial\ncrisis: the world economy in general, developing countries and LDCs in\nparticular are still struggling to recover from the 2008 financial crisis\ncontagion effects. With the looming crisis in WTO, world economy is not in a\nposition to face another crisis. <\/li><li>Trade growth: least\ndeveloped countries consists of 2\/3<sup>rd<\/sup> members of WTO. And their\ngrowth was increased due to increase in exports and imports to developed\ncountries. If we look at the growth of Africa, the total Africa\u2019s world\nmerchandise trade has increased, signifying the importance of trade for Africa\nand the world \u2013 exports increased by 51 percent between 2009 and 2011 and\nimports increasing by 36 percent during the same period. WTO logjam will send\nthis LDCs into dark ages again<\/li><li>India and its trade:\nIndian government aiming to double the share of its exports in world trade from\n1.5% to 3%. But rising tariff war between USA and China and European Union put\nIndian exports growth on doldrums.<\/li><li>Public stock holdings: India\nis home to more than 190 million people who are hunger and nearly 280 million\npeople who live below poverty line. To provide food security to this people\ngovernment of India implemented food security act in 2013. With the\nimplementation of act India is going to breach the 10% limits of subsidy. <\/li><li>With this breach other\nnations will drag the India to dispute settlement body, without appellant body India\nwill going to face the charges.<\/li><\/ul>\n\n\n\n<p><strong>Measures to overcome WTO impasse:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Taking a lead to break\nthe impasse, India is hosting a two-day informal meeting of 50 WTO members here\nwhich would deliberate upon ways to create a positive atmosphere for carrying\nforward the mandate of the global trade organization. India is expected to\npress for removal of protectionist measures and promotion of free trade as it\nwould benefit all the WTO member countries.<\/li><li>Consensus: developing\ncountries has the right to grow like developed countries. Developed countries\nare in advanced stage in growth and they need to help the LDCs and emerging and\ndeveloping economies by opening up their economies and to help WTO to implement\nthe Special and differential treatment (S&amp; DT) provisions. Developing\ncountries slowly and gradually open their economies to developed countries.<\/li><\/ul>\n\n\n\n<p><strong>Way forward:<\/strong> As the burns of\nglobal financial crisis on world economy are still healing and developed\ncountries and developing countries are not in a stage to afford another crisis.\n&nbsp;therefore the\nneed to reform the negotiating process that has proved to be dysfunctional and allow\nit to take into account not only the concerns of the big powers and emerging\npowers but developing countries concerns if WTO negotiations are to move\nforward.<\/p>\n\n\n\n<p>Source:<a href=\"https:\/\/www.thehindubusinessline.com\/opinion\/wto-struggling-to-stay%20relevant\/article28627776.ece\">https:\/\/www.thehindubusinessline.com\/opinion\/wto-struggling-to-stay\nrelevant\/article28627776.ece<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Context: WTO logjam and its impact on world economy.
