The verdict directly affects about 8 per cent\nof the country\u2019s population, close to 2 million forest dwellers.<\/li><li>After 15 days, on February 28, the\nMinistry of Tribal Affairs (MoTA), the nodal agency to implement FRA,\nintervened with a review petition. The apex court stayed its own order.<\/li><\/ul>\n\n\n\n<p><strong>The\nScheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest\nRights) Act, 2006 (FRA) and its importance:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Aim: <\/strong>FRA was intended to address the \u2018historical injustice\u2019 to India\u2019s \u2018traditional forest dwellers\u2019.&nbsp;<\/li><li>FRA is crucial to the rights of millions of tribal and other forest dwellers in different parts of our country as it provides for the restitution of deprived forest rights across India, including both individual rights to cultivated land in forestland and community rights over common property resources. <\/li><li><strong>FRA is potential tool:<\/strong><ul><li>To empower and strengthen the local self governance.<\/li><li>To address the livelihood security of the people, leading to poverty alleviation and pro poor growth.<\/li><li>To address the issues of Conservation and management of the Natural Resources and conservation governance of India.<\/li><\/ul><\/li><li><strong>Significance of the Act:<\/strong> The Act is significant as it provides scope and historic opportunity of integrating conservation and livelihood rights of the people.<ul><li>For the first time Forest Rights Act recognizes and secures.<\/li><li>Community Rights or rights over common property resources of the communities in addition to their individual rights.<\/li><li>Rights in and over disputed land Rights of settlement and conversion of all forest villages, old habitation, un-surveyed villages and other villages in forests into revenue villages.<\/li><li>Right to protect, regenerate or conserve or manage any community forest resource which the communities have been traditionally protecting and conserving for sustainable use.<\/li><li>Right to intellectual property and traditional knowledge related to biodiversity and cultural diversity.<\/li><li>Rights of displaced communities.<\/li><li>Rights over developmental activities.<\/li><\/ul><\/li><li><strong>The Act recognizes &#8211;<\/strong><ul><li>individual rights to forest land and livelihood<\/li><li>community rights to forest &#8216;land&#8217; exercised by their gram sabha<\/li><li>community forest &#8216;resource&#8217; rights, giving gram sabhas the power to protect and manage their forest<\/li><li>Recognized tribes are entitled to responsibilities and authority for sustainable use, conservation of biodiversity and maintenance of ecological balance<\/li><li>It has the provision for creating critical wildlife habitats within protected areas which currently is the strongest conservation provision among existing&nbsp;laws&nbsp;of the country.<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>Present\nlegal challenges:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Poor\nand tardy implementation of FRA:<\/strong> FRA has not been implemented\nproperly due to&nbsp;lack of political commitment; lack of adequate human and\nfinancial resources with the Department of Tribal Affairs.<\/li><li><strong>Forced\neviction:<\/strong>&nbsp;Judgment\nled to forced eviction of about two million people belonging to the Scheduled\nTribes and other forest communities.<\/li><li><strong>Against\nconstitutional provisions: <\/strong>Around 60% of the forest area in the\ncountry is in tribal areas. These are protected by Article 19(5) and Schedules\nV and VI of the Constitution; the area marked for eviction falls under these.\nIt specifically mentions that the State had to make laws for the protection of\nthe interests of any Scheduled Tribe. So the Court&#8217;s order is a disregard for\nthis core fundamental right protection to Adivasis. In fact, it is the responsibility\nof the Supreme Court to uphold the constitutional claims and equal citizenship.<\/li><\/ul>\n\n\n\n<p><strong>Conclusion:<\/strong> <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The FRA has tremendous potential to\nstrengthen the conservation regime across India by recognizing rights of forest\ndwellers over land and community forest resources. <\/li><li>By democratizing forest governance and\nconservation through the provision of rights and authority to local communities\nand gram sabhas for conservation and management of&nbsp;forests,&nbsp;the FRA\nwill empower gram sabhas of the forest dwelling communities to halt the\ndestruction of forests. <\/li><li>To achieve conservation justice, FRA\nmust be implemented in letter and spirit along with showing empathy for the\nforest dwellers. <\/li><li>Cutting down the Forests Right Act will\nonly weaken the conservation regime and affect the rights of forest dwellers,\ngovernment must work towards filling the gaps rather than choosing forced\neviction.<\/li><\/ul>\n\n\n\n<p><strong>Source:<\/strong> <a href=\"https:\/\/www.thehindu.com\/opinion\/op-ed\/the-taproot-of-conservation-justice\/article28801111.ece\">https:\/\/www.thehindu.com\/opinion\/op-ed\/the-taproot-of-conservation-justice\/article28801111.ece<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Context: TheScheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (FRA) and its importance.
