The Bill replaces the Consumer\nProtection Act, 1986. <\/p>\n\n\n\n<p><strong>Aim of the bill: <\/strong>The\nbill aims at protecting the interests of consumers by establishing authorities\nfor timely and effective administration and settlement of consumers\u2019\ndispute.&nbsp;<\/p>\n\n\n\n<p><strong>Definition\nof the consumer:<\/strong> A consumer is\ndefined as a person who buys any good or avails a service.&nbsp; It does not\ninclude a person who obtains a good for resale or a good or service for\ncommercial purpose.&nbsp; It covers transactions through all modes including\noffline and online through electronic means, teleshopping, multi-level marketing\nor direct selling.<\/p>\n\n\n\n<p><strong>Rights of consumers:<\/strong>&nbsp;Six consumer rights have been defined in the Bill, these\nare: <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The right to be protected against the\nmarketing of goods, products or services which are hazardous to life and\nproperty.<\/li><li>The right to be informed about the quality,\nquantity, potency, purity, standard and price of goods, products or services,\nas the case may be, so as to protect the consumer against unfair trade\npractices.<\/li><li>The right to be assured of &nbsp;access to a variety of goods, products or\nservices at competitive prices.<\/li><li>The right to be heard and to be assured\nthat consumer&#8217;s interests will receive due consideration.<\/li><li>The right to seek redressal against\nunfair trade practice or restrictive trade practices or unscrupulous exploitation\nof consumers.<\/li><li>The right to consumer awareness.<\/li><\/ol>\n\n\n\n<p><strong>Salient Features of the Bill:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Central Consumer Protection Authority:\u00a0<\/strong>The central government will set up a Central Consumer Protection Authority (CCPA) to promote, protect and enforce the rights of consumers.\u00a0 It will regulate matters related to violation of consumer rights, unfair trade practices, and misleading advertisements.<\/li><li><strong>Functions of CCPA: <\/strong><ul><li>issue safety notices<\/li><li>pass orders to recall goods, prevent unfair and restrictive trade practices<\/li><li>inquiring into violations of consumer rights, investigating and launching prosecution at the appropriate forum <\/li><li>reimburse purchase price paid<\/li><li>impose penalties for false and misleading advertisements. <\/li><li>It may also file complaints before the Consumer Disputes Redressal Commissions.<\/li><\/ul><\/li><li><strong>Consumer Disputes Redressal Commission:\u00a0<\/strong>CDRCs will be set up at the district, state, and national levels.\u00a0 A consumer can file a complaint with CDRCs in relation to:<ul><li>unfair or restrictive trade practices<\/li><li>defective goods or services<\/li><li>overcharging or deceptive charging<\/li><li>The offering of goods or services for sale which may be hazardous to life and safety.<\/li><\/ul><\/li><li><strong>Jurisdiction of CDRC:<\/strong><ul><li>District Commission: Up to Rs1 crore<\/li><li>State Commission: Between\u00a0 Rs1 crore and Rs 10 crore<\/li><li>National Commission: Above Rs.10 crore<\/li><\/ul><\/li><li><strong>Product liability:<\/strong>\u00a0Product liability means the liability of a product manufacturer, service provider or seller to compensate a consumer for any harm or injury caused by a defective good or deficient service.<\/li><li>The <strong>Basis for product liability<\/strong> action will be:<ul><li>Manufacturing\u00a0defect<\/li><li>Design defect<\/li><li>Deviation from manufacturing specifications<\/li><li>Not conforming to express warranty<\/li><li>Failing to contain adequate instruction for correct use<\/li><li>Services provided are faulty, imperfect or deficient<\/li><\/ul><\/li><li><strong>Ease of approaching consumer commission:<\/strong><ul><li>Filing from place of residence<\/li><li>E-filing<\/li><li>Videoconferencing for hearing\u00a0<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>Comparison of the Consumer Protection Act, 1986 with the Consumer Protection Bill, 2019:<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"519\" height=\"650\" src=\"https:\/\/i0.wp.com\/blogadmin.forumias.com\/wp-content\/uploads\/2019\/08\/provision.jpg?resize=519%2C650&#038;ssl=1\" alt=\"\" class=\"wp-image-50986\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"517\" height=\"155\" src=\"https:\/\/i0.wp.com\/blogadmin.forumias.com\/wp-content\/uploads\/2019\/08\/alt.jpg?resize=517%2C155&#038;ssl=1\" alt=\"\" class=\"wp-image-50987\"\/><\/figure>\n\n\n\n<p><strong>Benefit to Consumers:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Presently Consumer only have a single\npoint of access to justice, which is time consuming. Additional swift executive\nremedies are proposed in the bill through&nbsp;<strong>Central Consumer\nProtection Authority (CCPA)<\/strong><\/li><li>Deterrent punishment to&nbsp;<strong>check\nmisleading advertisements and adulteration of products<\/strong><\/li><li><strong>Product\nliability provision<\/strong>&nbsp;to deter manufacturers and service\nproviders from delivering defective products or deficient services<\/li><li><strong>Ease\nof approaching<\/strong>&nbsp;Consumer Commission and\nSimplification of Adjudication process<\/li><li>Scope for early disposal of cases through&nbsp;<strong>mediation<\/strong><\/li><li>Provision for rules for new age consumer\nissues:&nbsp;<strong>e-commerce &amp; direct selling<\/strong><\/li><\/ul>\n\n\n\n<p><strong>Conclusion:\n<\/strong>The\nConsumer Protection Act, 1986 was enacted to provide for better protection of\nthe interests of consumers and for the purpose of making provision for\nestablishment of consumer protection councils and other authorities for the\nsettlement of consumer disputes, etc. Although, the working of the consumer\ndispute redressal agencies has served the purpose to a considerable extent\nunder the said Act, the disposal of cases has not been fast due to various\nconstraints. The proposed Bill provides for the establishment of an executive\nagency &#8211; Central Consumer Protection Authority (CCPA). This fills an\ninstitutional void in the regulatory regime extant.
