Most of the preventive and regulatory powers are with executive\nmagistrates, but enforcement is carried out by the police.<\/li><li>However, at the metropolitan level, many\nstates have replaced the dual system with the commissionerate system as it is\nsupposed to allow for faster decision-making to solve complex urban-centric\nissues.<\/li><li>The colonial administration had created\ncommissioner system in the presidency towns of Calcutta, Bombay and Madras\nrecognising the unique needs of urban areas. Over a period of time, this system\nhas been found to be most effective in meeting policing requirements of big\ncities across India.<\/li><li>Initially, only four cities had the\nsystem namely Kolkata, Mumbai, Hyderabad and Chennai. But by 2016, 53 cities\nhad implemented this system.<\/li><li>As\nper the recommendation of the 1966 Khosla Commission, the police commissioner system\nwas introduced in Delhi from July 1, 1978, when Charan Singh was the home\nminister.<\/li><li>The\nsixth National Police Commission report,&nbsp;which was released in 1983,\nrecommended the introduction of a police commissionerate system&nbsp;in cities\nwith a population of 5 lakh and above, as well as in places having special\nconditions.<\/li><\/ul>\n\n\n\n<p><strong>The\nPolice Commissionerate System:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>In the commissionerate system, the\nCommissioner of Police (CP) is the head of a unified police command structure\nand is responsible for the force in the city, and is accountable to the state\ngovernment.&nbsp;<\/li><li>The office also has magisterial powers\nincluding those related to regulation, control and licensing.<\/li><li>The CP is usually drawn from the Deputy\nInspector General rank or above, and is assisted by Special\/Joint\/Additional\/Deputy\nCommissioners.<\/li><li>The commissioner system bestows\npreventive, regulatory and enforcement powers in the office of the police\ncommissioner, who is usually a senior police officer in the rank of ADG\/IG\nassisted by a number of additional commissioners, joint commissioners, deputy\ncommissioners and assistant commissioners.&nbsp;<\/li><li>Under the commissionerate system, the\ncommissioner does not report to the DM. In Mumbai and Delhi, he reports\ndirectly to the government. <\/li><li>It gives an integrated command\nstructure. It helps fix responsibility with the Commissioner and eliminates\nblame game between civil administration and police when something goes wrong.<\/li><li>The police commissionerate system is\nfunctioning in all the states expect for the Hindi belt regions of Uttar Pradesh,\nUttarakhand, Madhya Pradesh, Chhattisgarh, Bihar and Jharkhand.<\/li><li>The police\ncommissioners have the powers of executive magistrate or district magistrate\nfor 10 Acts, including the Indian Explosives Act, 1884; Mental Health Act, 1987;\nPoisons Act, 1919; Police (Incitement of Disaffection Act), 1922, Immoral\nTraffic (Preventive Act), 1956; Arms Act, 1959; Prevention of Cruelty to\nAnimals Act, 1960; Sarais Act, 1967; Cinematographer Act, 1952; and the Child\nMarriage Restrain Act, 1929. <\/li><li>It\u2019s a different set-up\nof policing that deals with the city areas. The crime investigating agency,\nspecial investigating units for economic offences, narcotics, gangsters,\ntechnical crimes and intelligence and urban crimes are dealt with specialised\nattention under the commissionerate system.<\/li><\/ul>\n\n\n\n<p><strong>The\nadvantages of the commissioner system:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The responsibility of law and order\nmaintenance is vested in a commissioner and there is complete clarity on chain\nof command as well as accountability.<\/li><li>There is only one single point of\nresponsibility when it comes to law and order, i.e, the commissioner of police.<\/li><li>The commissioner of police is directly\nand totally accountable to the state government for his performance. Thus, the\nreporting system is clear.<\/li><li>The commissioner system provides unified\norganisational command structure and powers to manage problems created by urban\ngrowth such as encroachment, anti-social activities, sudden law and order\nsituations, illicit\/ illegal liquor sale, drug peddling, etc.<\/li><li>It also creates necessary organisational\nindependence and homogeneity so that the police are able to use their\nprofessional understanding to deal with contemporary urban problems like\ntraffic regulation and evolve and innovate according to ground realities.<\/li><li>It provides specialisation in training\nand personnel management and faster and more effective response.<\/li><\/ul>\n\n\n\n<p><strong>Way\nforward:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>In November 2014 the Hon\u201fble PM unveiled\nhis vision for SMART Police \u2013 police which should be strict and sensitive,\nmodern and mobile, alert and accountable, reliable and responsible,\ntechno-savvy and trained.<\/li><li>Broadly, reforms are needed on three\nfronts: &nbsp;<\/li><li>improvement in capacity and infrastructure\nof police forces, <\/li><li>revisiting the constitution of police\nforces in the country through legislative\/ administrative changes, <\/li><li>Technological scaling-up.<\/li><li>The Supreme Court of India in Prakash\nSingh v. Union of India (2006) outlined some other administrative reforms to\nreform the police system. However, very few states have taken steps to comply\nwith the judgment. In the present times of cooperative federalism, the Centre\nneeds to sit with the states to motivate them to follow the following SC\ndirections: <\/li><li>Setting\nup of State Security Commission laying down broad policies and directions for\npolice functioning <\/li><li>Police\nEstablishment Board to decide on transfers, postings, promotions, and other\nservice related issues <\/li><li>Police\nComplaints Authorities at state and district levels as redressal mechanisms for\ncomplaints against police <\/li><li>Selection\nof DGP by the state government from panel of three senior-most officers of the\nDepartment who have been empaneled by the UPSC for promotion,<\/li><li>Fixed\ntenure of officers on operational duties<\/li><\/ul>\n\n\n\n<p><strong>Conclusion:<\/strong><\/p>\n\n\n\n<p>The needs for a\nfast growing economy like India for safe environment particularly in light of\nthe complex security threats in present times are imminent. Terrorism, Left\nWing Extremism, crimes including cyber-crimes, law and order issues threats\nwhich call for a strong and efficient police for internal security.
