the Government of India\n(Transaction of Business) Rules, 1961 allows the Prime Minister to depart from\nlaid down norms at his discretion.<\/li><li>The rule says that the Prime\nMinister may in cases or classes of cases permit or condone a departure from\nthese rules to the extent he deems necessary.<\/li><li>The Cabinet can subsequently give\npost-facto approval for any decision taken under Rule 12.<\/li><li>The rule also stipulates that to\ninvoke it,the proposal should be accompanied by a detailed justification\nclearly bringing out the urgency involved in the matter and the exceptional\ncircumstances that require it to be processed.<\/li><\/ul>\n\n\n\n<p><strong>Under\nwhat circumstances is Rule 12 used?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Rule 12 is usually not used to\narrive at major decisions by the government. <\/li><li>However, it has been used in\nmatters such as withdrawal of an office memorandum or signing of MoUs in cytoplasm.<\/li><\/ul>\n\n\n\n<p><strong>What\nwere the findings?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Scientists have found that SCGN\nhas a functional insulin-binding protein with therapeutic potential against\ndiabetes. <\/li><li>They show that SCGN binds to\ninsulin and protects it from various stresses, increases its stability as well\nas adds to its action.<\/li><li>They have also shown that\ninjection of SCGN (found at lower levels in diabetic patients) in obese\ndiabetic mice clears excess insulin from circulation and reduces fat decisions.<\/p>\n\n\n\n<p><strong>Facts:<\/strong><\/p>\n\n\n\n<p><strong>About Review\nPetition:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>According to the constitution,the\njudgment of the Supreme Court becomes the law of the land.It is final because\nit provides certainty for deciding future cases. <\/li><li>However,the Constitution under\nArticle 137 gives the Supreme Court the power to review any of its judgments or\norders. <\/li><li>This departure from the Supreme\nCourt\u2019s final authority is entertained only under specific and narrow grounds.<\/li><li>So, when a review takes place,the\nlaw is that it is allowed not to take fresh stock of the case but to correct\ngrave errors that have resulted in the miscarriage of justice.<\/li><\/ul>\n\n\n\n<p><strong>Grounds\nfor Review:<\/strong>In a 2013 ruling, the Supreme Court itself\nhad laid down three grounds for seeking a review of a verdict it has delivered:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The discovery of new and important\nmatter or evidence which after the exercise of due diligence was not within the\nknowledge of the petitioner or could not be produced by him.<\/li><li>Mistake or error apparent on the\nface of the record or <\/li><li>Any other sufficient reason.Any\nsufficient reason means a reason that is analogous to the other two grounds.<\/li><\/ul>\n\n\n\n<p><strong>Who can\nfile a review petition?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>It is not necessary that only\nparties to a case can seek a review of the judgment on it. <\/li><li>As per the Civil Procedure Code\nand the Supreme Court Rules, any person aggrieved by a ruling can seek a\nreview. <\/li><\/ul>\n\n\n\n<p><strong>Procedure\nfor review petition:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>As per 1996 rules framed by the\nSupreme Court,a review petition must be filed within 30 days of the date of\njudgment or order.<\/li><li>In certain circumstances,the court\ncan condone the delay in filing the review petition if the petitioner can\nestablish strong reasons that justify the delay.<\/li><li>Review petitions are also heard as\nfar as practicable by the same combination of judges who delivered the order or\njudgment that is sought to be reviewed.<\/li><\/ul>\n\n\n\n<p><strong>What if\na review
