The\u00a0state rules\u00a0are\u00a0recognised\u00a0under Article 35A of the Indian Constitution which entitled permanent residents of the State to free education along with reservation of government jobs and sole rights to land ownership.<\/li>\n<li><b><\/b><strong><b>Entitled\u00a0for:\u00a0<\/b><\/strong>The new rules entitle anyone who has worked or lived in the State for 15 years or studied there for seven years to receive a domicile certificate and the benefits previously reserved for permanent residents.<\/li>\n<li><b><\/b><strong><b>Entitle Union government officials:\u00a0<\/b><\/strong>Those who have served in the State for 10 years to domicile along with their non-resident children and list the categories of those eligible: members of the IAS (including those working in statutory bodies), public sector units and banks, central universities and \u2018recognised\u00a0research institutes of the Central government\u2019.<\/li>\n<\/ul>\n<p><strong><b>Problems in\u00a0changes\u00a0done to functioning of\u00a0Jammu and Kashmir:<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Marginalised\u00a0groups who were denied their rights:<\/b><\/strong>The\u00a0argument in support is that the\u00a0domicile rule notification\u00a0were necessary since many\u00a0marginalised\u00a0groups were denied their rights under the State subject law such as refugees from west Pakistan. Then this should also be expanded to the permanent resident category to include these groups, without doing away with it altogether.<\/li>\n<li><b><\/b><strong><b>Challenged in Supreme Court:\u00a0<\/b><\/strong>Changes are\u00a0said to be followed through by the President and Parliament of\u00a0India\u00a0but they ignore the fact that the presidential orders and\u00a0Reorganisation\u00a0Act of August 2019 are under constitutional challenge in the Supreme Court.<\/li>\n<li><b><\/b><strong><b>Lack of trust building:\u00a0<\/b><\/strong>After the announcement of\u00a0reorganisation\u00a0of Jammu and Kashmir, separate committees were set up to divide Jammu and Kashmir\u2019s assets between the two new Union Territories. The State police was put under direct rule by the Union Home Ministry. The Upper House of the Assembly was abolished. Land was taken for sale to industry, national tourist conglomerates were invited to take over what was a flourishing local industry and mining rights were sold to non-Kashmiri contractors.<\/li>\n<li><b><\/b><strong><b>Lack of political activities:\u00a0<\/b><\/strong>The Jammu and Kashmir Legislature remains dissolved and many of its political leaders remain under detention.\u00a0Their concerns are not incorporated.<\/li>\n<\/ul>\n<p><strong><b>Whether it is the last stroke on the state&#8217;s internal autonomy?<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Article 35A and the State subject law:<\/b><\/strong>Many see them as the last remaining bastion of the State\u2019s internal autonomy guaranteed under the instrument of accession signed by Maharaja Hari Singh.<\/li>\n<li><b><\/b><strong><b>Linked to identity:\u00a0<\/b><\/strong>These two grew to be closely tied to Kashmiri identity and Kashmiri empowerment through education and employment.<\/li>\n<li><b><\/b><strong><b>Fear of Demography change:\u00a0<\/b><\/strong>As armed insurgency rose in the 1990s, many Kashmiri political leaders raised fears of an Indian intention to alter the demography of the Muslim-majority Valley and several Jammu districts.<\/li>\n<li><b><\/b><strong><b>Rise in armed encounters:\u00a0<\/b><\/strong>With the fall of these laws, disaffection has exponentially multiplied in Jammu and Kashmir. In India, more than 90 million people have downloaded\u00a0Aarogya\u00a0Setu without showing any concern regarding the right to privacy.<\/li>\n<li><b><\/b><strong><b>Influence of\u00a0tech\u00a0giants:\u00a0<\/b><\/strong>Tech giants are taking a leading role in geopolitics and at times playing on their own and sometimes as proxies of nation states to influence policymaking and national regulations. For\u00a0example\u00a0the U.S.-China trade war, the position of governments on Huawei 5G technology etc.<\/li>\n<li><b><\/b><strong><b>For welfare of society:\u00a0<\/b><\/strong>The data need to be used towards the welfare of\u00a0society\u00a0but the sharing of data presents many challenges to human rights. COVID-19 is a good example of this.<\/li>\n<\/ul>\n<p><strong><b>Restrictions on the flow of data:<\/b><\/strong><\/p>\n<ul>\n<li>Across the world, data protection laws, requirements of data\u00a0localisation, laws related to weakening of\u00a0encryption keys and data retention requirements\u00a0such as the General Data Protection Regulation of the EU\u00a0are increasing\u00a0from\u00a0last few years.<\/li>\n<li><b><\/b><strong><b>Focus on protection of personal data:\u00a0<\/b><\/strong>Too much focus on it and privacy give little thought to the broader impact of data on mobility and social aspects.<\/li>\n<li><b><\/b><strong><b>Issue of data sharing:\u00a0<\/b><\/strong>Data protection frameworks such as the CLOUD Act of the U.S. is aimed at putting users in control of their data. But they have issues relating to data\u00a0localisation\u00a0and cross-border flow of information.<\/li>\n<\/ul>\n<p><strong><b>Use of Data in the post-COVID world:<\/b><\/strong><\/p>\n<ul>\n<li>Digital equity will require frameworks relating to governance of technology and data that look beyond geopolitical considerations.<\/li>\n<li>We need to distinguish individual data from large global data sets.<\/li>\n<li>We cannot decide the current human rights framework to human rights in the digital and biological domain.<\/li>\n<li>The current concept of privacy and cross-border flow of information may require significant change.<\/li>\n<li>There is a dire need to impose obligations for data flow on countries and tech giants in the larger interest of mankind.<\/li>\n<li>We need to establish a baseline of global norms of data governance that go beyond privacy and geopolitical considerations.<\/li>\n<\/ul>\n<p><strong><b>Way Forward<\/b><\/strong><\/p>\n<p>In the post-COVID world, countries and tech giants should be obligated to share data in the larger interest of mankind<\/p>\n<h3 class=\"note1\"><strong><b>3.<\/b><\/strong><strong><b>What does the government\u2019s stimulus package\u00a0have\u00a0in store?<\/b><\/strong><\/h3>\n<p><strong><b>Source:<\/b><\/strong>\u00a0<a href=\"https:\/\/www.thehindu.com\/opinion\/op-ed\/a-well-balanced-stimulus-package\/article31673510.ece\"><u>The Hindu<\/u><\/a><\/p>\n<blockquote><p><strong><b>Syllabus<\/b><\/strong>: GS-3- Economy-Indian Economy and issues relating to planning, mobilization of resources, growth, development and employment.<\/p><\/blockquote>\n<p><strong><b>Context<\/b><\/strong>: The government has announced special economic and comprehensive package of Rs 20 lakh\u00a0crores &#8211; equivalent to 10% of India\u2019s GDP- under the Atmanirbhar Bharat Mission.<\/p>\n<p><strong><b>Five tranches of the package:<\/b><\/strong><\/p>\n<ol>\n<li>The first tranche primary focus to alleviate the distress in the Micro, Small and Medium Enterprises sector.<\/li>\n<li>The second tranche dealt with\u00a0measures for the distressed migrant workers.<\/li>\n<li>The third tranche\u00a0included 11\u00a0measures for the agriculture sector.<\/li>\n<li>The fourth tranche included measures for commercial coal mining; coal gasification\u00a0projects; privatization\u00a0of\u00a0airports, optimization\u00a0of Indian airspace etc.<\/li>\n<li>The fifth tranche included allocation of additional Rs 40,000 crore for MNREGA, Technology Driven Online Education Systems,\u00a0decriminalization of Companies Act and health related initiatives.<\/li>\n<\/ol>\n<p><strong><b>Measures to boost Demand\u00a0Side\u00a0in the Economy:<\/b><\/strong><\/p>\n<ul>\n<li>1.73 lakh crore allocated for improving the incomes and welfare of the most vulnerable, including the 20 crore female Jan\u00a0Dhan\u00a0account holders;<\/li>\n<li>50,000 crore additional incomes to\u00a0 those whose TDS and TCS were reduced by 25%;<\/li>\n<li>40,000 crore additional allocation for MNREGA<\/li>\n<li>30,000\u00a0crore\u00a0for construction workers;<\/li>\n<li>17,800 crores transferred to 12 crore farmers;<\/li>\n<li>13,000 crores transferred to States to finance the costs of running quarantine homes and shelters for migrant workers.<\/li>\n<\/ul>\n<p><strong><b>Measures to boost Supply Side in the Economy<\/b><\/strong><\/p>\n<ol>\n<li><b><\/b><strong><b>Ensuring Food Security:\u00a0<\/b><\/strong>The government declared agriculture and all related activities as essential services amid Covid-19 pandemic lockdown. This\u00a0ensured\u00a0harvesting and efficient procurement of the critical Rabi crop.<\/li>\n<li><b><\/b><strong><b>Prevention of Insolvency and\u00a0Bankruptcy:\u00a0<\/b><\/strong>The government had announced moratorium for all businesses for their debt servicing obligations to commercial banks. Further, MSMEs were provided an additional credit line of\u00a0Rs.3 trillion without any fresh collateral.<\/li>\n<li><b><\/b><strong><b>Measures to improve ecosystem for private producers and investors:<\/b><\/strong><\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><b><\/b><strong><b>Agriculture:\u00a0<\/b><\/strong>The government\u00a0decided to amend Essential Commodities Act, 1955 to help provide the farmers with a better price\u00a0share. Also,\u00a0traders and exporters of\u00a0agro-products can maintain necessary stocks to meet export obligation<\/li>\n<li><b><\/b><strong><b>Defense:<\/b><\/strong>Government made further liberalization in the\u00a0defense\u00a0production sector<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><b><\/b><strong><b>Street vendors:<\/b><\/strong>street vendors across India have been given a credit of Rs.10,000 each for re-stocking.<\/li>\n<\/ol>\n<p><strong><b>Conclusion:\u00a0<\/b><\/strong>The economic stimulus package is expected to be a great boost and help in revival of the Indian economy. Package comprises of two modes: Liquidity push and Fiscal spending to give stimulus to economy.<\/p>\n<p><strong><b>Liquidity push<\/b><\/strong>\u00a0\u2013 Liquidity refers to ease of access to cash \u2014 a liquid asset is one that can be easily sold for or replaced with cash. The main intermediaries being enlisted for the task of transmitting liquidity are the banks and NBFCs. Steps taken for liquidity push-<\/p>\n<ul>\n<li>The \u2018targeted\u2019 long term repo operations (TLTROs)\u00a0&#8211;\u00a0TRO is a tool that lets banks borrow one to three-year funds from the central bank at the repo rate, by providing government securities with similar or higher tenure as collateral.<\/li>\n<\/ul>\n<p>It is called &#8216;Targeted&#8217;\u00a0LTRO\u00a0 as\u00a0in this case, the central bank wants banks opting for funds\u00a0\u00a0\u00a0under this option to be specifically invested in investment-grade corporate debt.<\/p>\n<ul>\n<li>NBFC\u2019s &#8211; Small Industries Development Bank of India, the National Bank for Agriculture and Rural Development, and the National Housing Bank\u00a0&#8211; These refinancing agencies\u00a0provide loans to different segments of economy which promote stimulus and demand.\u00a0The government offered them partial or full credit guarantees in case their clients defaulted.<\/li>\n<li>Temporary increase in the disposable income &#8211; Advance access to savings like provident fund contributions, lower tax deduction at source, reduced provident fund contributions and moratoriums on debt service payments promotes disposable income with citizens.<\/li>\n<\/ul>\n<p><strong><b>Criticism of liquidity push<\/b><\/strong><strong><b>\u00a0<\/b><\/strong><\/p>\n<ol>\n<li>No demand in market \u2013 Due to COVID associated\u00a0lockdown,\u00a0there has been loss of 122 million jobs which also lead to loss of income. In such scenario, there is absence of demand which in turn suppresses the investment by industries and thus their reluctance to borrow or increase liquidity.<\/li>\n<li>Loss to businesses \u2013 Small as well as big businesses have suffered huge losses which compounded to slowdown in economy in 2019 has\u00a0add\u00a0to their woes. This makes them\u00a0fearful for any new investments and new borrowings.<\/li>\n<li>Weaker transmission of repo rate policy\u00a0\u2013 RBI has slashed its repo rate for past 1 year to boost liquidity in system. However, banks have been reluctant to pass on these benefits to its borrowers\u00a0due to issues like Non-performing assets.<\/li>\n<\/ol>\n<p><strong><b>Suggested Solution &#8211;<\/b><\/strong>\u00a0Increased share of fiscal spending \u2013 Fiscal spending by government, although will increase fiscal deficit, but has the potential to increase liquidity in short-term which will revive the economy at faster rate than the liquidity push\u00a0measures(long-term steps). This\u00a0involves :<\/p>\n<ul>\n<li>New and additional transfers to people in cash and kind<\/li>\n<li>Wage subsidies<\/li>\n<li>Equity support<\/li>\n<li>spending on employment\u00a0programmes<\/li>\n<\/ul>\n<p><strong><b>Way Forward \u2013<\/b><\/strong>\u00a0Liquidity push and structural reforms\u00a0introduced in the mission\u00a0are much needed long-term measure for reviving economy.
