Out of this, only 10-20% raise important questions of law.<\/td>\n<td width=\"344\">\u00b7\u00a0The Supreme Court Rules, 2013 should amend provisions pertaining to Special Leave Petitions (SLPs).<\/p>\n<p>\u00b7\u00a0There should be a structure to provide for pre-hearing of SLPs.\u00a0Each SLP should be accompanied by an application for oral hearing which must be decided first by the Court.<\/p>\n<p>\u00b7\u00a0Only such SLPs in which oral hearing is permitted should be listed for hearing.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong><b>Way Forward:<\/b><\/strong><\/p>\n<p>The Law Commission of India in its 230th report provided measures to deal with the pendency of\u00a0cases plaguing\u00a0Indian Judiciary. It has highlighted their precarious socio-economic condition.<\/p>\n<p><strong><b>Previous steps taken by government to bridge the gap:<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Overall idea:\u00a0<\/b><\/strong>Idea of portable welfare benefits, that is, a citizen should be able to access welfare benefits irrespective of where she is in the country.<\/li>\n<li>The idea was first mooted under the UPA government by a Nandan Nilekani-led task force in 2011 in case of food rations.<\/li>\n<li>The current government committed to a national rollout of\u00a0ONORC:\u00a0<strong><b>Initial Plan:\u00a0<\/b><\/strong>by June 2020<\/li>\n<li><b><\/b><strong><b>With pandemic:\u00a0<\/b><\/strong>Changed to\u00a0March 2021.<\/li>\n<\/ul>\n<p><strong><b>Barriers to one nation one ration:<\/b><\/strong><\/p>\n<ol>\n<li><b><\/b><strong><b>The fiscal implications:\u00a0<\/b><\/strong>ON-ORC will affect how the financial burden is shared between states.<\/li>\n<li><b><\/b><strong><b>The larger issues of federalism and inter-state coordination:<\/b><\/strong>Many states are not convinced about a \u201cone size fits all\u201d regime because they have\u00a0customised\u00a0the PDS through higher subsidies, higher entitlement limits and supply of additional items.\u00a0For example-\u00a0Tamil Nadu implements a universal PDS in which every household is entitled.<\/li>\n<li><b><\/b><strong><b>The technology aspect:\u00a0<\/b><\/strong>ON-ORC requires a complex technology backbone that brings over 750 million beneficiaries, 5,33,000 ration shops and 54 million\u00a0tonnes\u00a0of food-grain annually on a single platform.<\/li>\n<\/ol>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-61692\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2020\/05\/Picture2-18.png?resize=589%2C309&#038;ssl=1\" alt=\"\" width=\"589\" height=\"309\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2020\/05\/Picture2-18.png?w=630&amp;ssl=1 630w, concerns which were dealt by GST can be helpful for ONOR:<\/b><\/strong><\/p>\n<p><b><\/b><strong><b>1.Fiscal concerns in GST:\u00a0<\/b><\/strong><\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>States like Tamil Nadu and Gujarat that are \u201cnet exporters\u201d were concerned they would lose out on tax revenues to \u201cnet consumer\u201d states like UP and Bihar.<\/li>\n<li>Finally, the Centre had to step in and provide guaranteed compensation for lost tax revenues for the first five years.<\/li>\n<li><b><\/b><strong><b>For ONORC:\u00a0<\/b><\/strong><\/li>\n<\/ol>\n<ol style=\"list-style-type: lower-roman;\">\n<li>The Centre\u00a0should\u00a0provide a similar assurance to \u201cnet inbound migration\u201d states such as Maharashtra and Kerala that any additional costs on account of migrants will be covered by it for the five years.<\/li>\n<\/ol>\n<p><b><\/b><strong><b>2.Broader issues of inter-state coordination:<\/b><\/strong><\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>Keeping the spirit of cooperative federalism, the central government created a GST council consisting of the finance ministers of the central and state governments to address these issues.<\/li>\n<li><b><\/b><strong><b>For ONORC:\u00a0<\/b><\/strong><\/li>\n<\/ol>\n<ol style=\"list-style-type: lower-roman;\">\n<li>The government\u00a0should\u00a0setup a\u00a0national council for ON-ORC\u00a0which should\u00a0meet regularly, have specific decision-making authority and should operate in a problem-solving mode based on consensus building.<\/li>\n<\/ol>\n<p><b><\/b><strong><b>3.Technology aspect:\u00a0<\/b><\/strong><\/p>\n<ul>\n<li>GST is supported by a sophisticated tech backbone, housed by the GST Network (GSTN), an entity jointly owned by the Centre and states.<\/li>\n<li><b><\/b><strong><b>ONORC:\u00a0<\/b><\/strong><\/li>\n<li>A similar system would be needed for ON-ORC.<\/li>\n<li><b><\/b><strong><b>PDS Network:\u00a0<\/b><\/strong>There should be\u00a0setting up of a PDS network (PDSN)\u00a0which\u00a0should incorporate principles such as inclusion, privacy, security, transparency, and accountability.<\/li>\n<\/ul>\n<p><strong><b>Learning from challenges of GST:<\/b><\/strong><\/p>\n<p><b><\/b><strong><b>Delay:\u00a0<\/b><\/strong><\/p>\n<ul>\n<li>Delay in GST refunds led to cash-flow issues.<\/li>\n<li>Similar delays in receiving food rations could be catastrophic.<\/li>\n<li>ON-ORC should create, publish and adhere to time-bound processes like right to public services legislation that have been adopted by 15 states and rapid grievance redress mechanisms.<\/li>\n<\/ul>\n<p><b><\/b><strong><b>Compliance burden:\u00a0<\/b><\/strong><\/p>\n<ul>\n<li>It fell most on the\u00a0MSMEs\u00a0digitised\u00a0overnight.<\/li>\n<li>PDS dealers would also face\u00a0similar challenges of overnight\u00a0digitalisation.<\/li>\n<li>Citizens will need to be shielded from the inevitable teething issues by keeping the system lenient at first, providing different ways of authenticating oneself and\u00a0publicising\u00a0a helpline widely.<\/li>\n<\/ul>\n<p><strong><b>Way Forward<\/b><\/strong><\/p>\n<p>ON-ORC is an opportunity to provide a reliable social protection backbone to
