He faced abuses and a cricketer who had represented India on the world stage was asked to prove his loyalty all over again simply on account of his faith.<\/li>\n<li><strong>Blow against race-neutrality:<\/strong>\n<ul>\n<li><strong>Indirect discrimination:\u00a0<\/strong>These damages pervade every aspect of life from access to basic goods to education and employment.<\/li>\n<li><strong>S. Supreme Court\u2019s ruling in Griggs vs. Duke Power Co. (1971):\u00a0<\/strong>It held that an energy company had fallen foul of the U.S. Civil Rights Act of 1964 which made racial discrimination in private workplaces illegal by insisting on a superfluous written test by applicants for its better entry-level jobs.\u00a0In practice,\u00a0it allowed the company to\u00a0victimiseAfrican-Americans.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Our Constitution has dealt with discrimination in public and private spheres.<\/p>\n<p><strong>Discrimination by the state:<\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Both direct and indirect forms of discrimination are against India\u2019s constitutional vision of equality.<\/li>\n<li><strong>Such as the\u00a0Delhi High Court in Madhu vs. Northern Railway (2018):<\/strong>The Railways had denied free medical treatment to the wife and daughter of an employee as it contended that the employee had \u201cdisowned\u201d his family and had had their names struck off his medical card.<\/li>\n<li>The court held that to make essential benefits such as medical services subject to a declaration by an employee might be \u201cfacially neutral\u201d but it produced a disparate impact particularly on women and children.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Discrimination in Private sphere:\u00a0<\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Such as entry barriers to goods such as housing, schools and employment.<\/li>\n<li><strong>Constitutional basis:<\/strong>Article 15(2) stipulates that citizens shall not on grounds only of religion, race, caste, sex or place of birth be denied access to shops, public restaurants, hotels and places of public entertainment.<\/li>\n<li><strong>Conflict:\u00a0<\/strong>This right comes into conflict with the rights of persons to associate with others often to the exclusion of certain groups.<\/li>\n<li><strong>Zoroastrian Cooperative Housing Society vs District Registrar Co-operative Societies (Urban) and Others (2005)<\/strong>: The SC ruled in\u00a0favourof a\u00a0bye-law\u00a0of a Parsi housing society that prohibited the sale of property to non-Parsis.<\/li>\n<li>The judgment conflated the freedom to contract with the constitutional freedom to associate\u00a0and alsooverlooked altogether Article 15(2).<\/li>\n<li><strong>The scope in Article 15(2):\u00a0<\/strong>The word \u201cshops\u201d used in it is meant to be read widely. A study of the Constituent Assembly\u2019s debates on the clause\u2019s framing shows us that the founders explicitly intended to place restrictions on any economic activity that sought to exclude specific groups. For example, when a person refuses to lease her property to another based on the customer\u2019s faith, such a refusal would run directly counter to the guarantee of equality.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Our civil liberties are capable of being threatened by acts of private individuals as well as the state. Nepal&#8217;s purposeful manner in pursuing the amendment at\u00a0the same\u00a0time as the India-China border stand-off further bolsters the belief.<\/li>\n<li><strong>Diplomatic failure:\u00a0<\/strong>India contends that it was willing to discuss matters at a mutually convenient date but Nepal says the MEA has rejected two dates suggested by Nepal and has routinely dismissed requests from the Nepal Ambassador for a meeting with the Foreign Secretary. It was further enraged by the MEA who said Kalapani talks could wait until both countries had dealt with the coronavirus pandemic first.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Need to Resolve issue:<\/strong><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Two nations must resolve their issues through dialogue before facing serious consequences.<\/li>\n<li><strong>Security issue for India:<\/strong>The deteriorating relations\u00a0could cause a security nightmare for India if it\u00a0opens up\u00a0other parts of their long boundary and reverses old commitments on open and unsecured border posts.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Way Forward<\/strong><\/p>\n<p>India and Nepal need to move quickly to reverse the recent setback to ties.<\/p>\n<h3 class=\"note1\"><strong>3.Fiscal relations\u00a0in times of COVID\u00a0<\/strong><\/h3>\n<p><strong>Source\u00a0<\/strong>\u2013\u00a0<a href=\"https:\/\/indianexpress.com\/article\/opinion\/columns\/coronavirus-finance-commission-india-fiscal-deficit-economic-package-covid-19-relief-measures-6458967\/\">Indian Express<\/a><\/p>\n<blockquote><p><strong>Syllabus \u2013<\/strong>\u00a0GS-2\u00a0Functions and responsibilities of the Union and the States, issues and challenges pertaining to the federal structure, devolution of powers and finances up to local levels and challenges therein.<\/p><\/blockquote>\n<p><strong>Context\u00a0\u2013\u00a0<\/strong>Covid exposes limits of centralized approach\u00a0of government where\u00a0Finance Commission must reset the balance in fiscal federalism.<strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>The 15th Finance Commission is expected to submit its report in about four months from now\u00a0and amid the pandemic\u00a0<\/strong><strong>has\u00a0to<\/strong><strong>\u00a0deal with the\u00a0following issues:<\/strong><strong>\u00a0<\/strong><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>Increased debt to GDP ratio<\/strong>&#8211; Factoring in the additional borrowings, the debt-to-GDP ratio may well be over 80 per cent this year.\u00a0Thus\u00a0the fiscal consolidation roadmap will have to be reworked, and as per its terms of reference, the Finance Commission will lay out the new path to be followed by both Centre and states. <strong>\u00a0<\/strong><\/li>\n<\/ol>\n<ol start=\"2\">\n<li><strong>State borrowings<\/strong>&#8211; Recently, the Centre eased the states\u2019 budget constraint, allowing them to borrow more this year, conditional upon them implementing reforms in line with the Centre\u2019s priorities. Finance Commission, in line with its terms of reference, can go along with the Centre\u2019s stance and recommend imposing conditions on additional borrowing and formalize this arrangement. <strong>\u00a0<\/strong><\/li>\n<\/ol>\n<ol start=\"3\">\n<li><strong>GST compensation\u00a0<\/strong><strong>cess<\/strong>&#8211; The GST council, in which the Centre effectively has a veto, is yet to clearly spell out its views on the extension of the compensation\u00a0cess\u00a0to offset states losses beyond the five-year period. At a time when the Centre is struggling to fulfill its promise of assuring states their GST revenues, will the Commission argue in\u00a0favour\u00a0of extending the compensation period, as states desire is another major challenge. <strong>\u00a0<\/strong><\/li>\n<\/ol>\n<ol start=\"4\">\n<li><strong>Tax devolution to states<\/strong>&#8211; The fiscal multiplier of central government capital spending is greater than that by the states. Also, Centralization of political power may well lead to demands for centralization of resources. Thus,\u00a0centre\u00a0would want reduced share of tax devolution.<strong>\u00a0<\/strong><\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><strong>Way Forward &#8211;\u00a0<\/strong>Any attempt to shift the uneasy balance in\u00a0favour\u00a0of the Centre will strengthen the argument that the government\u2019s talk of cooperative federalism serves as a useful mask to hide its centralizing tendencies. The functions played by police during Covid-19 lockdown are as follows:<\/p>\n<ul>\n<li>guarding containment zones,<\/li>\n<li>monitoring thousands of home quarantines,<\/li>\n<li>door-to-door help to elderly and isolated,<\/li>\n<li>distribute food to women\u2019s shelters,<\/li>\n<li>ferry medication and essential commodities to remote tribal communities,<\/li>\n<li>assist stranded\u00a0workers or facilitate their safe passage home.<\/li>\n<li>Launch helplines and conduct awareness programs<\/li>\n<\/ul>\n<p><strong>Police and\u00a0Public\u00a0trust issues:<\/strong><\/p>\n<ul>\n<li><strong>Police misconduct:\u00a0<\/strong>The lack of effective accountability mechanisms and periodic review of performance has misplaced the public\u2019s confidence in the police.<\/li>\n<li><strong>Lack of proper justice:<\/strong>Due to corruption in the police system and poor criminal investigation process, people tend to\u00a0lose\u00a0trust on police system.<\/li>\n<li><strong>Police Brutality:\u00a0<\/strong>In the recent years, there have instances of police brutality. For example,\u00a0Faizancase during the Delhi riots, 2020.<\/li>\n<\/ul>\n<p><strong>Other issues in the\u00a0Police\u00a0system:<\/strong><\/p>\n<ul>\n<li><strong>Archaic Police Act:<\/strong>Police is an exclusive subject under the State List (List II, Schedule 7 of the Indian Constitution).\u00a0Most of the states follow the archaic Indian Police Act 1861 with a few alterations.<\/li>\n<li><strong>Low police-to-population ratio:<\/strong>The global average ratio of police-population is 270 to 100,000, where it\u2019s 120 in India. The police system is thus highly understaffed\u00a0and\u00a0overburdened.<\/li>\n<li><strong>Modernization:\u00a0\u00a0<\/strong>The Comptroller and Auditor General (CAG) in its report \u201cCompendium on Performance Audit Reviews on Modernisation of Police Force\u201d highlighted that the\u00a0police\u00a0force continues to depend on outdated and unserviceable weapons.<\/li>\n<\/ul>\n<table>\n<tbody>\n<tr>\n<td width=\"601\"><strong>Supreme Court directions in Prakash Singh vs Union of India 2006<\/strong><\/p>\n<p>The Supreme Court had put forward a slew of recommendations as follows:<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Constitute a State Security Commission in every state to lay down policy for police functioning, evaluate police performance, and ensure that state governments do not\u00a0excessively influence on the police.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Constitute a Police Establishment Board in every state to decide postings, transfers and promotions of officers below rank of DSP.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Constitute Police Complaints Authorities to inquire allegations of police\u00a0misconduct<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 minimum tenure of at least two years for the DGP<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Separate the investigating police from the law and order police<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Way Forward:\u00a0<\/strong>The challenges faced by the police system requires immediate attention\u00a0from the government and reforms should be initiated at the earliest.\u00a0The concept of Strict and Sensitive, Modern and Mobile, Alert and Accountable, Reliable and Responsive; Techno-savvy and Trained (SMART) policing introduced in 2014 is a\u00a0step-in\u00a0right direction.<\/p>\n<h3 class=\"note1\"><strong>5.COVID-19 and public transport<\/strong><\/h3>\n<p><strong>Source\u00a0&#8211;\u00a0<\/strong><a href=\"https:\/\/www.thehindu.com\/opinion\/op-ed\/making-public-transport-safe-during-covid-19\/article31828057.ece\"><strong>The Hindu<\/strong><\/a><\/p>\n<blockquote><p><strong>Syllabus\u00a0\u2013 GS 3 &#8211;\u00a0<\/strong>Infrastructure: Energy, Ports, Roads, Airports, Railways etc<\/p><\/blockquote>\n<p><strong>Context &#8211;\u00a0<\/strong>Based on opinion surveys, a significant drop in public transport ridership can be expected for months after easing the lockdown.<\/p>\n<p>India closed its public transport during shutdown which is considered as one of the most lethal public places\u00a0to promote the community transmission of virus.<\/p>\n<p><strong>Reasons for the apprehensions associated with public transport system are<\/strong>:<\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li><strong>Contact based commutation<\/strong>&#8211; Possibility of viral transmission through tokens, tickets, push buttons on lifts, and handrails at the station elevators are high as contact-less commutation is absent in India.<\/li>\n<li><strong>Crowding<\/strong>\u2013 The population boom and the non-availability of enough numbers of pubic vehicle for commutation led to high crowding in the few available transport systems. This makes social distancing a mere rhetoric in public vehicles.<\/li>\n<li><strong>Indoor-like environment<\/strong>&#8211; Correlation to the effect of air conditioning airflow has also been established based on precise seating locations of those infected at a restaurant and at a call centre which holds true for air conditioned buses and metro rails also.<\/li>\n<li><strong>Absence of culture of hygiene\u00a0<\/strong>\u2013 Bathrooms with water availability and other hand sanitizing facilities are not there in majority of bus, railway or metro stations.<\/li>\n<\/ol>\n<p>All these challenges has the potential that people shift from public to private mode of transport which will have following\u00a0<strong>implications<\/strong>:<\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>Increase\u00a0in\u00a0fuel consumption and thus, more air pollution.<\/li>\n<li>Heavy traffic, more noise pollution and longer commutation time.<\/li>\n<li>Increase in number of accidents and human lives lost in such accidents.<\/li>\n<\/ol>\n<p><strong>Suggested solutions\u00a0to promote culture of hygiene in public transport systems:<\/strong><\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li><strong>Contact-less commutation \u2013\u00a0<\/strong>This involves compulsory use of cards or e-ticketing. The regular sanitization of handrails, handgrips, and buttons on lift by the newly hired staff will create more hygienic public stations.\u00a0Signs on hand hygiene\u00a0vis-a-vis\u00a0touching surfaces are needed.<\/li>\n<li><strong>Increasing fleet of public transport<\/strong>\u2013 This\u00a0is a solution which also solves the issue of increasing air pollution on account of use of private vehicles by people.
