This happens to take the advantage of the views of the opposition\u00a0for\u00a0betterment\u00a0of democracy.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>The problems in RS elections are not new and certain changes are introduced to correct it.<\/p>\n<p><strong><b>Dealing with the issues of Rajya Sabha elections:<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Rajya Sabha S B Chavan Committee (1999):\u00a0<\/b><\/strong>It mooted the idea of voting by open ballots in the elections to the upper house to prevent big money and other considerations to play a role in the electoral process.<\/li>\n<li><b><\/b><strong><b>Parliament passed a law in 2003:<\/b><\/strong>It<strong><b>\u00a0<\/b><\/strong>required MLAs to show their votes to their\u00a0party man\u00a0before voting in a RS election.<\/li>\n<li><b><\/b><strong><b>Supreme Court in 2006:\u00a0<\/b><\/strong>It decided that\u00a0crossvoting\u00a0would not attract the penalty under the anti-defection law. The blatant use of money became evident in the 2016 RS elections in Karnataka where an MLA was caught\u00a0for purportedly\u00a0asking money on tape.<\/li>\n<li><b><\/b><strong><b>The open ballot provides legal and technical grounds for invalidating votes:<\/b><\/strong><\/li>\n<li>In the 2017 Gujarat\u00a0RS\u00a0election two Congress MLAs were suspected by their party of voting for the BJP candidate as they had shown their votes to the BJP\u2019s election agent. As a result, their votes were held invalid.<\/li>\n<li>In 2016 Haryana, 12 Congress MLA\u2019s votes were held invalid after using an unofficial violet pen for voting.<\/li>\n<\/ul>\n<p><strong><b>Way Forward<\/b><\/strong><\/p>\n<p>The Probity in RS polls can be ensured by internal change in parties along with stricter laws.<\/p>\n<h3 class=\"note1\"><strong><b>2.India\u2019s quest for UNSC reforms<\/b><\/strong><\/h3>\n<p><strong><b>Source\u00a0<\/b><\/strong>\u2013\u00a0<a href=\"https:\/\/www.thehindu.com\/opinion\/editorial\/at-the-high-table-the-hindu-editorial-on-indias-un-security-council-win\/article31863713.ece\"><u>The Hindu<\/u><\/a><\/p>\n<blockquote><p><strong><b>Syllabus<\/b><\/strong>\u00a0\u2013 GS 2 \u2013\u00a0Important International institutions, agencies and\u00a0fora- their structure, mandate.<\/p><\/blockquote>\n<p>Context &#8211;\u00a0India must adopt value-based positions at the UNSC and be the voice of the weaker nations to bring the required reforms in the multilateral institution.<\/p>\n<p>India was the only contestant for the Asia Pacific seat and got 184 votes in the 193-strong General Assembly to win the seat for Non-permanent membership granted for 2 years in the UNSC.<\/p>\n<p>India sought the support of member countries by highlighting its commitment to the achievement of\u00a0<strong><b>N.O.R.M.S:\u00a0<\/b><\/strong>a<strong><b>\u00a0New Orientation for a Reformed Multilateral System<\/b><\/strong>\u00a0in its campaign brochure which was launched before the voting.<\/p>\n<p>The campaign brochure\u00a0has\u00a0set out the\u00a0following\u00a0<strong><b>key priorities<\/b><\/strong>\u00a0for India:<\/p>\n<ol>\n<li><strong><b>New Opportunities for progress<\/b><\/strong>\u00a0&#8211;\u00a0A rapidly shifting global security landscape, persistence of traditional security challenges, and emergence of new and complicated challenges, all demand a coherent, pragmatic, nimble and effective platform for collaboration to ensure sustainable peace.<\/li>\n<li><strong><b>An Effective response to international terrorism<\/b><\/strong>\u00a0\u2013 India will push for the India-led Comprehensive Convention on International Terrorism to tackle the challenge of terrorism.ill pursue concrete and result-oriented action by<\/li>\n<li><strong><b>Reforming the multilateral system<\/b><\/strong>\u2013\u00a0There is\u00a0widespread concern at the\u00a0inadequacy of\u00a0the existing multilateral institutions\u00a0to\u00a0deliver results or meet new challenges.\u00a0Thus, there is\u00a0need to\u00a0promote greater cooperation\u00a0in\u00a0multilateral institutions.<\/li>\n<li>A\u00a0<strong><b>comprehensive approach to international peace and security<\/b><\/strong>\u00a0&#8211;\u00a0Streamlining UN Peacekeeping is an overdue task. We must ensure\u00a0greater clarity, direction, and professionalism in UN Peacekeeping Operations.<\/li>\n<li><strong><b>Promoting technology with a human touch as a driver of solutions<\/b><\/strong> \u2013 India aims to promote use of technological advancement for good of all including the under-developed nations who lack such resources to fight challenges like climate change.<\/li>\n<\/ol>\n<p><strong><b>India\u2019s approach in next two year will be guided by &#8220;Five S\u2019s\u201d,<\/b><\/strong>\u00a0as set out by the Prime Minister:<\/p>\n<p><strong><b>\u2022<\/b><\/strong>\u00a0Samman\u00a0(Respect),<br \/>\n<strong><b>\u2022\u00a0<\/b><\/strong>Samvad\u00a0(Dialogue),<br \/>\n<strong><b>\u2022\u00a0<\/b><\/strong>Sahyog\u00a0(Cooperation), and<br \/>\n<strong><b>\u2022<\/b><\/strong>\u00a0Shanti\u00a0(Peace), to create conditions for universal<br \/>\n<strong><b>\u2022<\/b><\/strong>\u00a0Samriddhi\u00a0(Prosperity)<\/p>\n<p><strong><b>Challenges<\/b><\/strong>\u00a0which need effective solutions to bring reforms:<\/p>\n<ol>\n<li><b><\/b><strong><b>The Group \u201cUniting for Consensus\u201d (UFC)<\/b><\/strong>\u2013 It is\u00a0led\u00a0by Italy, Argentina, Pakistan, Mexico\u202fsupports an extended Council of 25 members, which oppose the G4 (Germany, Japan, India and\u00a0Brazil )\u00a0and the addition of any new permanent seats. The\u00a0UfC\u00a0would instead add only non-permanent seats and preferably abolish the veto or at least restrict its use.<\/li>\n<li><b><\/b><strong><b>Resistance by Permanent<\/b><\/strong>&#8211;<strong><b>5\u00a0<\/b><\/strong>&#8211; The P5 are generally hesitant towards reform. Of the five, France and Britain are most open to reform. Whilst all permanent members accept the reform in principle, they have often fought popular reform proposals.<\/li>\n<li><b><\/b><strong><b>Rivalry between USA and China during the pandemic\u00a0<\/b><\/strong>&#8211;\u00a0The Security Council is one of the most important multilateral decision-making bodies where the contours of global geopolitics are often drawn. India should avoid the temptation of taking sides at a time when the Security Council is getting more and more polarised due to USA-China rivalry.<\/li>\n<\/ol>\n<p><strong><b>Way Forward<\/b><\/strong>\u00a0&#8211;\u00a0India has long been of the view that the structure of the UN Security Council doesn\u2019t reflect the realities of the 21st century. Legislation has given it the legal structure and safeguards and provided the assurance that the courts will implement mediation agreements.<\/p>\n<p><strong><b>Advantages of the online mediation:<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Convenient:\u00a0<\/b><\/strong>\n<ul>\n<li>It enables the mediator and the parties to\u00a0assemble\u00a0on their computer screens.<\/li>\n<li>Discussion can be guided by giving parties and lawyers the opportunity to put forth their views.<\/li>\n<li>When separate meetings are required, the mediator can easily move the other party and its lawyer to another virtual room.<\/li>\n<\/ul>\n<\/li>\n<li><b><\/b><strong><b>Cost effective and an efficient use of time:<\/b><\/strong>\n<ul>\n<li>Parties do not have to bear costs, do not have to travel, do not have to wait long hours and do not have to undergo adjournments and multiple visits to the mediation\u00a0center.<\/li>\n<li><b><\/b><strong><b>Easy to get people from different locations to one platform:\u00a0<\/b><\/strong>It done away with difficulties of distances where parties\u00a0are in\u00a0different countries.<\/li>\n<\/ul>\n<\/li>\n<li><b><\/b><strong><b>Giving the participant a little cocoon of safety:<\/b><\/strong>As it creates a grainy barrier of two screens and an intermediate world of Internet. It will certainly be of benefit in cases where emotions run high and face-to-face confrontation may increase the conflict. Such as in matrimonial cases and in family business disputes.<\/li>\n<\/ul>\n<p><strong><b>Weaknesses of the online mediation:<\/b><\/strong><\/p>\n<ul>\n<li><b><\/b><strong><b>Missing the directness and complete contact:<\/b><\/strong>It is possible only in face-to-face meetings in the courtroom.<\/li>\n<li><b><\/b><strong><b>Compromise of confidentiality:<\/b><\/strong>As hearings could be recorded.\u00a0Service providers\u00a0must\u00a0be vigilant and\u00a0there should be\u00a0rules to\u00a0penalize\u00a0participants for breach.<\/li>\n<li><b><\/b><strong><b>Technical glitches:\u00a0<\/b><\/strong>There can be issues with screen clarity and interrupted feed.<\/li>\n<li><b><\/b><strong><b>Exclusion of underprivileged:\u00a0<\/b><\/strong>Critics argue\u00a0that online communication will exclude the underprivileged who cannot afford access to the Internet or do not have the capacity or assistance to use it.<\/li>\n<\/ul>\n<p><strong><b>Way Forward<\/b><\/strong><\/p>\n<p>Online mediation has a host of advantages to reaped but it\u00a0must\u00a0bear some caution. These include machineries, including electrical machinery, semiconductor driven machinery etc.<\/li>\n<li>20% of the auto components and 70% of electronic components come from China. This is, thus, a matter of collective shame for all of us.<\/li>\n<li><strong><b>Economic slowdown<\/b><\/strong>\u2013 With oil prices being low, India still witnessed the growth rate of 4.2 per cent, the lowest growth seen in the last 11 years.\u00a0This could have been averted with better economic policies focussing on structural reforms in manufacturing, agriculture and financial sector.<\/li>\n<li><strong><b>Over-exploitation of resources<\/b><\/strong>\u2013 To meet the economic needs, we over-exploited the resources and environment which led to degradation of environment and contributes in global warming phenomena.<\/li>\n<\/ol>\n<p>Lack of empathy for vulnerable as well as environment\u00a0<strong><b>resulted<\/b><\/strong>\u00a0into rising poverty and unemployment despite abundance, rising intolerance and violence, and environmental catastrophe.<\/p>\n<ol>\n<li><b><\/b><strong><b>Rising poverty and unemployment<\/b><\/strong>&#8211; After the lockdown, India\u2019s unemployment rate shot up to a record high of 23.8 per cent in April. Most of the unemployed being labourers as industries were closed during the lockdown.
