{"id":68718,"date":"2020-11-04T17:49:27","date_gmt":"2020-11-04T12:19:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=68718"},"modified":"2021-01-15T11:22:59","modified_gmt":"2021-01-15T05:52:59","slug":"lgbt-community-rights","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/lgbt-community-rights\/","title":{"rendered":"LGBT community rights"},"content":{"rendered":"<p><strong>Context-\u00a0<\/strong>Issues and Challenges of same sex marriages in India.<\/p>\n<p><strong>What is Solicitor General Verdict on same sex marriage?<\/strong><\/p>\n<p>Same-sex marriages\u00a0are neither a part of \u201cour culture\u201d nor a part of the law, Solicitor General Tushar Mehta told the Delhi High Court Monday, opposing a petition demanding marriage rights for the\u00a0gay community\u00a0under the Hindu Marriage Act 1955.<\/p>\n<p><strong>What is the history of same sex marriage in India?<\/strong><\/p>\n<p>Same-sex marriages are not a new phenomenon in India.<\/p>\n<ul>\n<li>Hindu scriptures define marriage as the union of \u2018two souls\u2019 and the same scriptures also define that a\u00a0soul has no gender. It is only the human bodies that possess a gender.<\/li>\n<li>These scriptures are a major source of Hindu Law including the Act. The Act merely codifies the Hindu law and doesn\u2019t try to erode the values imbibed within the Holy Scriptures.<\/li>\n<li>The 11th-century Sanskrit text, the Kathasaritsagara, provides the same explanation for cross-class and cross-caste couples who want to marry.<\/li>\n<\/ul>\n<p><strong>What are difficulties faces by LGBT [lesbian, gay, bisexual and transgender] community?<\/strong><\/p>\n<ol>\n<li><strong>Legal recognition-\u00a0<\/strong>Same-sex marriages are not legally recognized in India.<\/li>\n<\/ol>\n<ul>\n<li><strong>For example-\u00a0<\/strong>Recently, a PIL was filed in the High Court of Delhi seeking declaration to the marriage rights of the gay community under the\u00a0<strong>Hindu Marriage Act, 1955.<\/strong><\/li>\n<li>The petitioner avers that the Act allows marriages between \u201ctwo Hindus\u201d without any discrimination between heterosexual and homosexual couples.<\/li>\n<li>But still, gay couples can\u2019t get married and register the same under the Act.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong>Deprived in Rights\u00a0<\/strong>\u2013 The rights enjoyed by opposite-sex couples are not enjoyed by same-sex couples. They are prohibited from those rights. For example-<\/li>\n<\/ol>\n<ul>\n<li>The lack of a legal structure around their relationship became increasingly stark when they tried to bring each other on as nominees in insurance and financial plans, just as a married couples did.<\/li>\n<li>Most male-female married couples take for granted that the day after they marry, they can open a joint account, make health and funeral-related decisions for each other, and inherit each other\u2019s property.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>Families violently separated the same sex couples, often driving them to suicide.<\/li>\n<li><strong>Racial Discrimination<\/strong>\u2013\u00a0Additionally, lesbian, gay, bisexual and transgender people suffer from social and economic inequalities due to continuous discrimination.<\/li>\n<\/ol>\n<p><strong>Way forward-<\/strong><\/p>\n<ul>\n<li>Countries around the world have legalized same-sex marriages. The world is heading towards progressive LGBTQ rights.
