{"id":69565,"date":"2020-11-13T20:31:57","date_gmt":"2020-11-13T15:01:57","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=69565"},"modified":"2021-06-12T18:50:40","modified_gmt":"2021-06-12T13:20:40","slug":"what-is-contempt-of-court-and-why-does-the-a-g-have-to-consent-to-these-proceedings","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/what-is-contempt-of-court-and-why-does-the-a-g-have-to-consent-to-these-proceedings\/","title":{"rendered":"What is \u2018contempt of court\u2019, and why does the A-G have to consent to these proceedings?"},"content":{"rendered":"<p><strong>News:<\/strong>\u00a0Attorney General has given his consent for the initiation of criminal contempt proceedings against stand-up comedian Kunal Kamra for his tweets following the Supreme Court\u2019s decision to grant interim bail to a television anchor.<\/p>\n<p><strong>Facts:<\/strong><\/p>\n<ul>\n<li><strong>Contempt of Court:<\/strong> As per the Contempt of Courts Act 1971, contempt refers to the offense of showing disrespect to the dignity or authority of a court.<\/li>\n<li><strong>Types<\/strong>: The act divides contempt into civil and criminal contempt.\n<ul>\n<li><strong>Civil contempt<\/strong>: It is willful disobedience to a judgment, decree, direction, order, writ or other processes of a court or wilful breach of an undertaking given to the court.<\/li>\n<li><strong>Criminal contempt:<\/strong>\u00a0It means the publication (whether by words, spoken or written or by signs or by visible representations) of any matter or the doing of any other act whatsoever which\n<ul>\n<li>scandalizes or tends to scandalize or lowers or tends to lower the authority of, any court; or<\/li>\n<li>prejudices, or interferes or tends to interfere with, the due course of any judicial proceeding; or<\/li>\n<li>interferes or tends to interfere with or obstructs or tends to obstruct, the administration of justice in any other manner.<\/li>\n<\/ul>\n<\/li>\n<li>In 2006, the government brought in an amendment which now provides \u201ctruth\u201d as defence provided it is bona fide and in public interest.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Prior Consent of AG:\u00a0<\/strong>According to <a href=\"https:\/\/forumias.com\/blog\/contempt-of-court\/\" target=\"_blank\" rel=\"noopener\">Contempt of Court Act<\/a>, 1971, prior consent in writing of the Attorney General(AG) is required for the Supreme Court to initiate criminal contempt action in a case.<\/li>\n<li><strong>Punishment<\/strong>: A contempt of court may be punished with:\n<ul>\n<li>Simple imprisonment which may extend to six months or<\/li>\n<li>Fine which may extend to two thousand rupees or With both.<\/li>\n<li>However,the accused may also be discharged or the punishment awarded may be remitted on apology being made to the satisfaction of the court.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Read Also :-<a class=\"seoquake-params-link\" href=\"https:\/\/forumias.com\/blog\/polity\/important-acts\/\" rel=\"58628df9 x_url\">Important Acts\u00a0<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>News:\u00a0Attorney General has given his consent for the initiation of criminal contempt proceedings against stand-up comedian Kunal Kamra for his tweets following the Supreme Court\u2019s decision to grant interim bail to a television anchor.
