{"id":72076,"date":"2020-12-07T17:01:45","date_gmt":"2020-12-07T11:31:45","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=72076"},"modified":"2021-05-10T14:32:24","modified_gmt":"2021-05-10T09:02:24","slug":"issues-in-labour-codes","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/issues-in-labour-codes\/","title":{"rendered":"Issues in Labour codes"},"content":{"rendered":"<p><strong>Context<\/strong>: The <a href=\"https:\/\/forumias.com\/blog\/issues-in-labour-codes\/\" target=\"_blank\" rel=\"noopener\">labour codes<\/a> will only better India\u2019s \u2018ease of doing business\u2019 ranking instead of improving conditions of employment<\/p>\n<p><strong>What is the Significance of Labour codes?<\/strong><\/p>\n<ul>\n<li>Will generate employment and secure the basic rights of the workers.<\/li>\n<li>It will universalise the right to minimum wage of workers and social security entitlements.<\/li>\n<\/ul>\n<p><strong>Why, have the labour codes not been universally welcomed by workers?<\/strong><\/p>\n<ul>\n<li><strong>Social Security net is not universal:<\/strong> The codes mandate benefits of Employees\u2019 State Insurance (ESI) and Provident Fund (PF) only for workers belonging to establishments employing 10 workers or more. This leaves out nearly 80% of all Indian workers in the informal sector from the ambit of these benefits.<\/li>\n<li><strong>Inadequate hospitals and dispensaries under ESI<\/strong>\n<ul>\n<li>The ESI employed around six doctors per one lakh beneficiaries in 2016, as against the World Health Organization norm of 100 doctors.<\/li>\n<li>With the new codes seeking to cover 20% of all workers, the membership would further increase to around 10 crore workers a three-time increase over the membership in 2019 (3.6 crore). The available capacity of the hospitals and dispensaries would evidently be inadequate.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Disparity on ESI coverage between states: <\/strong>The ESI coverage follows the map of industrial growth in the country. Thus, in industrialised States like Karnataka and Tamil Nadu, the ESI covered is around 20% of the population as beneficiaries in 2016 whereas, for Bihar the ESI covered is only 0.7%.<\/li>\n<li><strong>Abridgement of cess-based welfare boards<\/strong>: The new labour codes also does away with a number of existing cess-based welfare schemes.
