{"id":75206,"date":"2021-01-04T12:20:06","date_gmt":"2021-01-04T06:50:06","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=75206"},"modified":"2021-01-04T12:20:06","modified_gmt":"2021-01-04T06:50:06","slug":"preamble-of-india","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/preamble-of-india\/","title":{"rendered":"About the Preamble of the Indian Constitution"},"content":{"rendered":"<p><strong>News:<\/strong>The Constitution particularly its <a href=\"https:\/\/forumias.com\/blog\/preamble-of-indian-constitution\/\" target=\"_blank\" rel=\"noopener noreferrer\">Preamble of the Indian<\/a> , has frequently been at the centre of the ongoing debate over the Citizenship Amendment Act.<\/p>\n<p><strong>Facts:<\/strong><\/p>\n<p><strong>About Preamble:<\/strong><\/p>\n<ul>\n<li>The term \u2018preamble\u2019 refers to the introduction or preface to the Constitution.It contains the summary or essence of the Constitution.<\/li>\n<li>It serves two purposes namely (a)indicates the source from which the Constitution derives its authority and (b)It also states the objects which the Constitution seeks to establish and promote.<\/li>\n<\/ul>\n<p><strong>Source of Preamble of the Indian :<\/strong><\/p>\n<ul>\n<li>The Preamble is based on the Objective Resolution moved by Jawaharlal Nehru in the Constituent Assembly on December 13,1946.The Resolution was adopted on January 22, 1947.<\/li>\n<li>On October 17, 1949,the Constituent Assembly presided by Rajendra Prasad took up the Preamble for discussion.<\/li>\n<li>It was adopted on 26 November 1949 by the Constituent Assembly and came into effect on 26 January 1950, celebrated as the Republic Day in India.<\/li>\n<\/ul>\n<p><strong>Preamble:<\/strong>The Preamble to the Constitution of India states:<\/p>\n<p><strong>\u201cWe<\/strong>,<strong>THE PEOPLE OF INDIA<\/strong>, having solemnly resolved to constitute India into a\u00a0<strong>SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC\u00a0<\/strong>and to secure to all its citizens:<\/p>\n<p><strong>JUSTICE<\/strong>, social, economic and political;<\/p>\n<p><strong>LIBERTY<\/strong>\u00a0of thought, expression, belief, faith and worship;<\/p>\n<p><strong>EQUALITY<\/strong>\u00a0of status and of opportunity; and to promote among them all;<\/p>\n<p><strong>FRATERNITY<\/strong>\u00a0assuring the dignity of the individual and the unity and integrity of the Nation:<\/p>\n<p>IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION\u201d<\/p>\n<p><strong>Amendments:<\/strong><\/p>\n<ul>\n<li>The original Preamble, adopted by the Constituent Assembly in 1949, declared India a \u201cSovereign Democratic Republic\u201d.<\/li>\n<li>By the 42nd Amendment of 1976, the words \u201cSocialist\u201d and \u201cSecular\u201d were inserted; the Preamble now reads \u201cSovereign Socialist Secular Democratic Republic\u201d.<\/li>\n<\/ul>\n<p><strong>Supreme Court cases related to <a href=\"https:\/\/forumias.com\/blog\/answeredbring-out-the-philosophy-of-the-indian-polity-as-enshrined-in-the-preamble-of-the-indian-constitution-also-discuss-various-changes-made-to-preamble-since-its-adoption-in-indian-constitution\/\" target=\"_blank\" rel=\"noopener noreferrer\">Preamble of the Indian<\/a> :<\/strong><\/p>\n<p><strong>Berubari Union case,1960:<\/strong><\/p>\n<ul>\n<li>The Supreme Court said that the Preamble shows the general purposes behind the several provisions in the Constitution.<\/li>\n<li>However,it held that the Preamble is not a part of the Constitution.It is also not the source to prohibit the power which is given explicitly in the Constitution.Further,the Preamble is also not enforceable in a Court of Law.<\/li>\n<\/ul>\n<p><strong>Kesavananda Bharaticase,1973:<\/strong><\/p>\n<ul>\n<li>The Supreme Court rejected the earlier opinion (in the Berubari Case) and held that the Preamble is a part of the Constitution.<\/li>\n<li>It has observed that Preamble is subject to the amending power of the Parliament as are any other provisions of the Constitution,provided the basic structure of the Constitution is not destroyed.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News:The Constitution particularly its Preamble of the Indian , has frequently been at the centre of the ongoing debate over the Citizenship Amendment Act.
