{"id":84901,"date":"2020-01-14T17:34:40","date_gmt":"2020-01-14T12:04:40","guid":{"rendered":"http:\/\/factly.forumias.com\/?p=12947"},"modified":"2020-01-14T17:34:40","modified_gmt":"2020-01-14T12:04:40","slug":"transgender-persons-act-comes-into-effect","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/transgender-persons-act-comes-into-effect\/","title":{"rendered":"Transgender Persons Act comes into effect"},"content":{"rendered":"\n<p><strong>News:<\/strong> Ministry of Social Justice and Empowerment notified Transgender Persons (Protection of Rights) Act, 2019<\/p>\n\n\n\n<p><strong>Facts:<\/strong><\/p>\n\n\n\n<p><strong>Transgender Persons (Protection of Rights) Act, 2019<\/strong><\/p>\n\n\n\n<p><strong>Aim<\/strong>: Social, economic and educational empowerment of transgender persons.<\/p>\n\n\n\n<p><strong>Definition of Transgender<\/strong>: Those whose gender does not match the gender assigned to that person at birth.<\/p>\n\n\n\n<p><strong>Key Provisions:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>&nbsp;<strong>Right to Self-Identification<\/strong>: Person would have the right to choose to be identified as a man, woman or transgender, irrespective of sex reassignment surgery and hormonal therapy.<\/li><li><strong>Acquiring Certificate:<\/strong> transgender persons need to go through a district magistrate and district screening committee to get certified as a transpersons<\/li><li><strong>Prohibition of Discrimination<\/strong>: No discrimination against transgender persons in accessing education, employment and healthcare<\/li><li><strong>National Council for Transgender persons (NCT):<\/strong> It would advise the central government on related policies and legislation and also act as a centre for grievance redressal<\/li><li><strong>Responsibilities of Government<\/strong>:<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>&nbsp;Provide health facilities to transgender persons including separate HIV surveillance centres<\/li><li>Provide, through an insurance scheme, medical expenses for sex reassignment surgery, hormonal therapy, laser therapy or any such health-related<\/li><li>&nbsp;expenses<\/li><li>Take steps for rescue and rehabilitation, vocational training and self-employment<\/li><li>Create transgender sensitive schemes, and promote their inclusion in cultural activities<\/li><\/ul>\n\n\n\n<p><strong>Additional Information:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>NALSA Judgement, 2014:<\/strong> The Supreme Court in National Legal Services Authority v. Union of India &amp; Ors. upheld that transgenders should be treated as a third gender for the purpose of safeguarding their fundamental rights.<\/li><li><strong>Section 377 Judgement, 2018<\/strong>: SC in Navtej Singh Johar v. Union of India case decriminalised homosexuality by partially striking down the certain provisions of Section 377 of the Indian Penal Code (IPC).<\/li><\/ol>\n\n\n\n<p><strong>Marriage between Man and Trans woman<\/strong>: In April 2019, Madras High Court upheld that the marriage solemnised between a man and a trans woman was valid under the Hindu Marriage Act, 1955 and ordered its registration.
