{"id":89233,"date":"2019-08-28T18:25:34","date_gmt":"2019-08-28T12:55:34","guid":{"rendered":"http:\/\/factly.forumias.com\/?p=9603"},"modified":"2019-08-28T18:25:34","modified_gmt":"2019-08-28T12:55:34","slug":"habitat-rights-for-chhattisgarh-tribals-in-naxal-area-soon","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/habitat-rights-for-chhattisgarh-tribals-in-naxal-area-soon\/","title":{"rendered":"Habitat rights for Chhattisgarh tribals in Naxal area soon"},"content":{"rendered":"\n<ol class=\"wp-block-list\"><li>The Chhattisgarh government is processing\nhabitat rights under Scheduled Tribes and Other Traditional Forest Dwellers\n(Recognition of Forest Rights) Act, 2006 for Abujh Marias, a Particularly\nVulnerable Tribal Group (PVTG).<\/li><li>The Abujh Marias live in Abujhmarh forest area\nin Bastar district of Chhattisgarh. <\/li><li>The Scheduled Tribes and Other Traditional\nForest Dwellers (Recognition of Forest Rights) Act, 2006 seeks to recognize\nforest rights of Scheduled Tribes and other traditional forest dwellers who\nhave been occupying and are dependent on the forest land for generations. <\/li><li>The Act recognizes a) Community Rights or rights\nover common property resources of the communities in addition to their\nindividual rights, b) right of ownership, access to collect, use, and dispose\nof minor forest produce, c) Rights in and over disputed land Rights of\nsettlement and conversion of all forest villages, old habitation, un-surveyed\nvillages and other villages in forests into revenue villages, d) right to\nprotect, regenerate or conserve or manage any community forest resource which\nthe communities have been traditionally protecting and conserving for\nsustainable use, e) right to rehabilitation in case of illegal eviction or\ndisplacement from forest land, f) Right to intellectual property and\ntraditional knowledge related to biodiversity and cultural diversity<\/li><li>Section 3(1) (e) of FRA, 2006 entitles PVTGs with\nhabitat rights over their entire habitation and ensures protection of culture\nand way of life.<\/li><li>The PVTGs are the marginalized section of the\nScheduled tribes of India. They are a section who are relatively isolated,\neducationally and socio-economically backward, living in a habitat far away\nfrom amenities.<\/li><li>PVTG is not a Constitutional category, nor are\nthese constitutionally recognized communities. It is a government of India\nclassification created with the purpose of enabling improvement in the\nconditions of certain communities with particularly low development<\/li><li>The criteria followed for determination of PVTGs\nare: a) A pre-agriculture level of technology, b) A stagnant or declining\npopulation; c) Extremely low literacy; and d) A subsistence level of economy.<\/li><\/ol>\n","protected":false},"excerpt":{"rendered":"<p>The Chhattisgarh government is processing habitat rights under Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 for Abujh Marias, a Particularly Vulnerable Tribal Group (PVTG).
