{"id":89757,"date":"2019-07-24T14:46:15","date_gmt":"2019-07-24T09:16:15","guid":{"rendered":"http:\/\/factly.forumias.com\/?p=8402"},"modified":"2019-07-24T14:46:15","modified_gmt":"2019-07-24T09:16:15","slug":"madhya-pradesh-passes-bill-to-raise-obc-quota-to-27-overall-73","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/madhya-pradesh-passes-bill-to-raise-obc-quota-to-27-overall-73\/","title":{"rendered":"Madhya Pradesh passes Bill to raise OBC quota to 27%, overall 73%"},"content":{"rendered":"\n<ol class=\"wp-block-list\"><li>The\nMadhya Pradesh Assembly has passed the Madhya Pradesh Public Service\n(Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes)\nAmendment Bill 2019.<\/li><li>The\nbill raises the reservation in government jobs and education for Other Backward\nClasses (OBC) to 27% from the present 14%.<\/li><li>The\n13% more reservation for OBCs along with the 10% quota for economically weaker\nsections (EWS) in government jobs takes the total reservation in Madhya Pradesh\nto 73%.This has breached the 50% cap on reservation imposed by the Supreme\nCourt in 1992.<\/li><li>The\nSupreme Court in the Indira Sawhney case (1992), had held that the power\nconferred to the State by Clause (4) of Article 16 should be exercised in a\nfair manner and within reasonable limits. The court upheld that reservation\nunder Clause (4) shall not exceed 50% of the appointments or posts, barring\ncertain extraordinary situations<\/li><li>Article\n16 (4) empowers the State to make provision for the reservation of appointments\nor posts in favour of any backward class of citizens which, in the opinion of\nthe State, is inadequately represented in public employment.<\/li><\/ol>\n","protected":false},"excerpt":{"rendered":"<p>The Madhya Pradesh Assembly has passed the Madhya Pradesh Public Service (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Amendment Bill 2019.
