{"id":89880,"date":"2019-11-14T15:27:27","date_gmt":"2019-11-14T09:57:27","guid":{"rendered":"http:\/\/factly.forumias.com\/?p=11571"},"modified":"2019-11-14T15:27:27","modified_gmt":"2019-11-14T09:57:27","slug":"cji-office-comes-under-rti-ambit","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/cji-office-comes-under-rti-ambit\/","title":{"rendered":"CJI Office comes under RTI ambit"},"content":{"rendered":"\n<p><strong>News:<\/strong> A\nfive-judge bench of the Supreme Court has ruled that the office of Chief\nJustice of India (CJI) comes under the purview of the Right to Information\n(RTI) Act.<\/p>\n\n\n\n<p><strong>Facts:<\/strong><\/p>\n\n\n\n<p><strong>Background:<\/strong> The\nverdict comes in the matter of a plea filed by Supreme Court Secretary-General\nchallenging Delhi High Court\u2019s 2010 order holding that the CJI&#8217;s office is a\n&#8220;public authority&#8221; and falls under the ambit of the RTI Act.<\/p>\n\n\n\n<p><strong>Key takeaways from SC\nVerdict:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The Supreme Court of India and the office of the\nCJI are not two different public authorities. The SC would necessarily include\nthe office of CJI and other judges in view of Article 124 of the Constitution (Establishment\nand Constitution of Supreme Court)<\/li><li>Right to Information and Right to Privacy are\ntwo sides of the same coin. They have to be balanced while deciding to give out\ninformation from the office of the chief Justice. <\/li><li>Judicial independence and accountability go hand\nin hand, but transparency does not undermine judicial independence. <\/li><li>Disclosure of any information sought will have\nto be balanced with the independence of judiciary, which itself is a matter of\npublic interest.<\/li><li>The Court has asked the information commissioner\nto apply test of proportionality while entertaining applications seeking\ninformation from CJI&#8217;s office, keeping in mind right to privacy and\nindependence of judiciary.<\/li><\/ul>\n\n\n\n<p><strong>Additional\nInformation<\/strong><\/p>\n\n\n\n<p><strong>Right to Information Act, 2005:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>RTI\n Act provides for timely disclosure of information by citizens from both\n central and State Public Authorities. It seeks to empower citizens and\n promote accountability and transparency.<\/li><li>Under\n the Act, Public Authorities are required to make disclosures on various\n aspects of their structure and functioning.&nbsp; This includes<ul><li>disclosure\n on their organization<\/li><li>functions\n and structure<\/li><li>powers\n and duties of its officers and employees and<\/li><li>Financial\n information.<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>Note<\/strong>: Public authority\u201d is defined in Section 2(h) of the RTI Act.
