{"id":90000,"date":"2019-03-20T17:42:21","date_gmt":"2019-03-20T12:12:21","guid":{"rendered":"http:\/\/factly.forumias.com\/?p=2793"},"modified":"2019-03-20T17:42:21","modified_gmt":"2019-03-20T12:12:21","slug":"supreme-court-bats-for-hit-and-run-accident-victims-2","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/supreme-court-bats-for-hit-and-run-accident-victims-2\/","title":{"rendered":"Supreme Court bats for hit-and-run accident victims"},"content":{"rendered":"\n<ol class=\"wp-block-list\"><li>The Supreme Court has called for a \u201csecured and\nfool proof\u201d method of distribution compensation to victims of hit and run\ncases. <\/li><li>Recently, the Supreme Court had accepted court\nappointed committee\u2019s recommendation to increase the minimum compensation for\ndeath in a hit-and-run case from the existing Rs 25,000 to Rs 2 lakh. The\nSupreme Court had constituted the committee headed by Justice Radhakrishnan in\n2014.<\/li><li>The Court observed that the present amount of\ncompensation inadequate and the law should be amended to enhance the amount. It\ndirected the Centre and General Insurance Council to frame a scheme of payment\nof compensation to ensure that the amount is paid to the right claimant till\nthe law is amended.<\/li><li>The General Insurance (GI) Council is a part of\nthe Insurance Association of India. It regulates the growth of the general\ninsurance industry and maintains customer service. It was established under the\nIndian Insurance Act 1938.<\/li><li>In \u2018Hit &amp; Run\u2019 cases, accident victims are\neligible for compensation through a Special Fund constituted in terms of\nSection 163 of the Motor Vehicles Act, 1988 called \u2018Solatium Fund\u2019.<\/li><li>The Motor Vehicles (Amendment) Bill, 2017 which seeks\nto amend Motor Vehicles Act, 1988 has been passed in Lok Sabha but is pending\nin Rajya Sabha. The bill calls for Rs 2 lakh or more to the victim\u2019s family as\ncompensation for deaths in hit-and-run cases. It also calls for establishing a Motor\nVehicle Accident Fund to provide compulsory insurance cover to all road users\nin India for certain types of accidents.<\/li><\/ol>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has called for a \u201csecured and fool proof\u201d method of distribution compensation to victims of hit and run cases.
