Synopsis<\/span><\/b>:\u00a0<\/span>Recently Facebook India head appealed in the Supreme Court <\/span>against\u00a0<\/span>the summon<\/span>\u00a0by<\/span>\u00a0Delhi Assembly.\u00a0\u00a0<\/span>SC should avoid any interference in the <\/span>assembly\u2019s<\/span> right to discussion on important public matters.\u00a0<\/span>\u00a0<\/span><\/p>\n

Background<\/span><\/b>\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

A few months ago, the Delhi Legislative assembly issued a notice to the head of Facebook India, <\/span>Ajit<\/span>\u00a0Mohan<\/span>. The notice was for him to appear in front of the <\/span>Assembly\u2019s Peace and Harmony Committee<\/span>. This committee is investigating the Delhi Riots.\u00a0<\/span>\u00a0<\/span><\/p>\n

Ajit<\/span>\u00a0Mohan filed a petition against this notice in Supreme Court. Hearing on this case is ongoing.\u00a0<\/span>\u00a0<\/span><\/p>\n

This petition will have implications on<\/span>\u00a0the separation of powers<\/span>,\u00a0<\/span>federalism<\/span>\u00a0and fundamental rights in India<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

Why Court should not interfere in Assembly\u2019s right to discussion<\/span><\/b>\u00a0<\/span><\/p>\n

S<\/span>et of rights and immunities<\/span>\u00a0granted to Parliament are called\u00a0<\/span>Parliamentary privileges<\/strong>. The House of Commons has been granted the <\/span>right to free speech\u00a0<\/span>and<\/span>\u202fthe right to call for evidence and witnesses in the House<\/span>\u00a0since 1689. Both Parliament and State Assemblies are granted with same privileges.\u00a0<\/strong><\/span>\u00a0<\/strong><\/p>\n

There are some misleading doubts that\u00a0<\/span>State Assemblies<\/span>\u00a0are on par with parliament on these matters.\u00a0<\/span>\u00a0<\/span><\/p>\n

  1. Firstly,<\/span><\/b> discussion in legislatures are not only a part of law-making, it is also used in its\u202fnon-judicial power of inquiry<\/strong>.\u00a0<\/span>This inquiry power is inherent to the legislature<\/span> as it is the voice of the people of the state. For example, states inquire into the possible ecological implications of a nuclear waste site within the State<\/span>. States often hear testimony from soldiers and pass resolutions to honour the armed forces.\u00a0<\/span>\u00a0<\/span><\/li>\n
  2. Secondly<\/span><\/b>, it is not necessary that all discussions lead to lawmaking. Some discussions end with the arguments only. <\/span>Thus, the interference of courts before the conclusion of the debate<\/strong> will be pointless.\u00a0<\/span>\u00a0<\/span><\/li>\n
  3. Third,\u00a0<\/span><\/b>Co-<\/strong>operative federalism<\/strong> cannot be promoted if assemblies are barred from even discussing matters, which are beyond their legislative competence. <\/span>\u00a0<\/span><\/li>\n
  4. Fourth,<\/span><\/b>\u00a0Judiciary ought not to enter the domain where it will examine the proceedings of the house. It is against the separation of power<\/strong>.\u00a0<\/span>\u00a0<\/span><\/b>\u00a0<\/span><\/li>\n
  5. Fifth,<\/span><\/b> the experiences of Canada and Australia<\/strong> in this matter also, go against any Court mandated restrictions on legislative competence.\u00a0<\/span>\u00a0<\/span><\/li>\n<\/ol>\n

    Free speech in the house is a landmark of liberty. It allows\u00a0<\/span>elected representatives\u00a0<\/span>on behalf of people\u00a0<\/span>to challenge the most powerful people of the land<\/span>. It would be incorrect if the Court appoints itself as an <\/span>arbiter of legislative discussions<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n
