The bill claims that its aim is to implement the Supreme Court judgments on Delhi\u2019s governance structure. However, the proposed changes are the very opposite of what the Court has said.<\/span><\/p>\n<h5><strong>What was the Supreme Court&#8217;s 2018 verdict on the matter?<\/strong><\/h5>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The <strong>Constitution Bench verdict in 2018<\/strong> stated that the LG (Lieutenant Governor) has <strong>not been trusted with any independent decision-making power<\/strong>.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The LG either has to <strong>act on the aid and advice of council ministers.<\/strong> Or, he has to implement the decision of the President on the matters referred to him.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The <strong>\u2018aid and advice\u2019 clause applies to<\/strong> the matters on which the Delhi Assembly has powers under the State and Concurrent Lists. <\/span><span style=\"font-weight: 400;\">This comes with an <strong>exception of public order, police, and land<\/strong>. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Wherever there are differences between the L-G and the elected government, the L-G should refer the question to the President.<\/span><\/li>\n<li>Further, different judgments have clarified that the <strong>power to refer \u201cany matter\u201d to the President does not mean &#8220;every matter&#8221;<\/strong>.<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This bill completely undermines the Court\u2019s efforts. The judgment strengthened the elected government in relation to Lieutenant Governor.\u00a0<\/span><\/li>\n<\/ul>\n<p><strong>Read more<\/strong> &#8211; <strong><a href=\"https:\/\/forumias.com\/blog\/the-government-of-nct-of-delhi-amendment-bill-2021-explained-pointwise\/\">NCT Amendment Bill<\/a><\/strong><\/p>\n<h5><b>What are the issues with the NCT amendment bill?\u00a0<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Court wanted to clarify that the power to refer any matter to the President did not mean that every matter should be referred.\u00a0<\/span><\/p>\n<ol>\n<li><b>Firstly,<\/b><span style=\"font-weight: 400;\"> the Bill states all references to the government in the bills and orders would mean the LG. It is irrational to declare<\/span><b> LG as the government, in the UT with an elected House<\/b><b>.<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\"><b>As per the<\/b><\/span><span style=\"font-weight: 400;\"><strong> guiding principle,<\/strong> an elected government should not be undermined by the unelected administrator. <\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Secondly,<\/b><span style=\"font-weight: 400;\"> the provision to Article 239AA empowers L-G to refer the matter to the President, in case of difference of opinion. However, <\/span>this does not mean that <b>the <\/b>administrator should come up with a<b> different opinion on every government decision<\/b><span style=\"font-weight: 400;\">.<\/span>\n<ul>\n<li>However, the bill provides the L-G with an opportunity to refer every matter to the President.<\/li>\n<\/ul>\n<\/li>\n<li><b>Third,<\/b><span style=\"font-weight: 400;\"> instead of Parliament identifying the matters on which the L-G\u2019s opinion should be required, <\/span><b>the Bill proposes that the L-G himself would specify such matters.<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">This bill amounts to a rollback of representative government.\u00a0<\/span><span style=\"font-weight: 400;\">The Union Territory concept is one of the many ways in which India regulates relations between the Centre and its units.
