Ramana, the senior-most judge of the Supreme Court as the next CJI.<\/p>\n<h5><strong>About Chief Justice of India(CJI):<\/strong><\/h5>\n<ul>\n<li><a href=\"https:\/\/forumias.com\/blog\/absence-of-regular-chiefs-in-central-security-forces\/\"><strong>Chief Justice of India<\/strong><\/a> is the chief judge of the Supreme Court of India. He\/she is also the highest-ranking officer of the Indian judiciary.<\/li>\n<\/ul>\n<p><strong>Constitution on appointment of CJI:<\/strong><\/p>\n<figure id=\"attachment_97927\" aria-describedby=\"caption-attachment-97927\" style=\"width: 320px\" class=\"wp-caption alignright\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-97927 size-full\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2021\/03\/RamanaJPG.jpg?resize=320%2C328&#038;ssl=1\" alt=\"Justice Ramana\" width=\"320\" height=\"328\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2021\/03\/RamanaJPG.jpg?w=320&amp;ssl=1 320w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2021\/03\/RamanaJPG.jpg?resize=293%2C300&amp;ssl=1 293w\" sizes=\"auto, (max-width: 320px) 100vw, 320px\" \/><figcaption id=\"caption-attachment-97927\" class=\"wp-caption-text\">Source : The Hindu<\/figcaption><\/figure>\n<ul>\n<li>The Constitution of India <strong>does not have any specific provision<\/strong> for criteria and procedure for<\/li>\n<li>\u00a0appointing the CJI.<\/li>\n<li><strong>Article 124(1) and the 2008 amendment <\/strong>of the Indian Constitution states that there shall be a Supreme Court of India consisting of a Chief Justice of India and no. of judges as prescribed by Parliament.<\/li>\n<li>Initially, the prescribed no. of judges was 7 excluding CJI. Now the no. is 34 judges including the CJI.<\/li>\n<li>The closest mention is in <strong>Article 126. <\/strong>It deals with the appointment of an acting CJI.<\/li>\n<\/ul>\n<h5><strong>Convention for appointment of CJI<\/strong><\/h5>\n<ul>\n<li>When the incumbent CJI retires (all Supreme Court judges retire at the age of 65), the <strong>senior-most judge<\/strong> in the SC becomes the CJI.<\/li>\n<li>Seniority is <strong>not defined by age <\/strong>but by the number of years an individual has served as a judge of the apex court.<\/li>\n<\/ul>\n<p><strong>What is the procedure? <\/strong>The procedure to appoint the next CJI is laid out in the Memorandum of Procedure (MoP) between the government and the judiciary.<\/p>\n<ul>\n<li>Firstly, the procedure is initiated by the <strong>Law Minister.<\/strong> He\/she shall seek the recommendation of the outgoing CJI at the \u2018appropriate time\u2019(near to the date of retirement of the incumbent CJI).<\/li>\n<li>Secondly, the <strong>CJI sends his recommendation to the Law Ministry. <\/strong>If there are any doubts, the CJI can consult the <strong>collegium<\/strong> as per article 124(2), regarding the fitness of an SC judge to be elevated to the post.<\/li>\n<li>Thirdly, after receiving a recommendation from CJI, the <strong>law minister forwards it to the Prime Minister. <\/strong>The PM will then advise the same to the President.<\/li>\n<li>Then lastly, <strong>President<\/strong> administers the oath of office to the new CJI.<\/li>\n<\/ul>\n<p><strong>Does the government get a say in the appointment of CJI?<\/strong><\/p>\n<ul>\n<li><strong>Except for the law minister<\/strong> seeking the recommendation from the incumbent CJI and forwarding it to the Prime Minister, the government <strong>has no say<\/strong> in the appointment of the CJI.<\/li>\n<li><strong>However<\/strong>, the key difference between the appointment of the CJI and the other SC judges are,\n<ul>\n<li><strong>In the appointment of CJI<\/strong>, the government cannot send the recommendation of the CJI (or the collegium) back for reconsideration.<\/li>\n<li><strong>But in the appointment of SC Judges,<\/strong> the government can do so. However, if the collegium reiterates those names then the government cannot object any further.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Are there any exceptions to the above-mentioned procedure?<\/strong><\/p>\n<ul>\n<li>This convention has been broken twice. In 1973, Justice A. N.
