Read Article 326 once again, carefully, like a lawyer. ON THE BASIS OF A-326, the law defining right to vote is made. Read the whole article, end to end. 😀
RPA fir se padho bhailog. Wohi ek act UPSC ne specifically syllabus me mention kiya hain 😀

To answer the doubts on Right to Vote, let us return to the exact wording of the Constitution.
A- 326. “Elections to the House of the People and to the Legislative Assemblies of States to be on the basis of adult suffrage..”
ON THE BASIS OF being the key legal term. The Right is given by RPA.
Last part: “..as may be fixed in that behalf by or under any law made by the appropriate legislature and is not otherwise disqualified under this constitution or any law made by the appropriate Legislature on the ground of non residence, unsoundness of mind, crime or corrupt or illegal practice, shall be entitled to be registered as a voter at any such election.”
Read RPA thoroughly people, its the only act specifically included in syllabus. Read it like a Law student.

Yaar aise me to chote chote concepts hi hil jayenge
Article 326 of the Constitution guarantees the right to vote to every citizen above the age of 18; hence shd be a constitutional right. ?
Youre aabsolutely right bhaii. Ab yaar, yeh toh laucha hain..!! Only SC can answer you query…Abhi ke liye Ratta hee Maarna hoga..!! Aur search maarta hun..!!
Arre haan jee sir…bhool gayaa mei….Article or ques dono hee dimaag mei ghoom rahe the…FR waal concept hain 32 mei toh…!! true bhaaii…!! Neend Poori nahi hui i guees..!! Thanks Thanks!!
Article 32 is applicable only for fundamental right and not to any other rights provided under constitution.
Article 326 clearly states that every person who is a citizen of India and who is not less than 18 of age shall have the right to vote unless he is not disqualified by any law made by Legislature on the ground of non-residence, unsoundness of mind, crime or corrupt or illegal practice, shall be entitled to be registered as a voter at any such election.
This is the basis of Universal Adult Suffrage and gives people right to vote. Since, this right flows from constitution, it should be a constitutional right, not fundamental per se. It definitely shouldn’t be statutory as there’s no statute that declares that people have a right to vote. Parliament can only impose restrictions on the aforementioned grounds.
I fail to understand Supreme Court’s stances on serious issues like this or even LGBT rights. Baki time fokat me activism dikhate rahte hain, kisi ko cricket khila rahe hain, kisi ko anthem suna rahe hain.
Hi Supreme Leader,
I agree with you that it is statutory right.
But, if it is constitutional right and not FR, it will still be dismissed under Article 32 as petition under this article can be filed only on violation of FR.

Ps- Constitutional rights are completely protected from governmental interference and are guaranteed by the constitution.
It is 62 (1) of RPA, 1951 that confers citizens of India the Right to Vote.
It is thus a Statutory Right or Legal Right.

Here it is mentioned that right to vote is provided by constitution and Rp act,1951. So how can it be statutory only?
