    Whats stopping Mr. X from buying citizenship in Mauritius/ or setting up a 3rd party resident company whose parent company and main investor i.e. Mr. X still operates from South Africa?

    Seems like a lame clause to me.

    The countries have been given freedom to propose their own targets and the UN will only track if they are enough. Thus, the domestic efforts pledged by the countries would provide an international framework to the future climate deal.

    May be question wanted to ask nationals targets are set up by agreement or are countries are free to propose their own targets.
    However, At the Paris climate conference (COP21) in December 2015, 195 countries adopted the first-ever universal, legally binding global climate deal. Hence, there will be some penalty for not adhering to the targets proposed by the countries according to me

    Some information related to LoB principle

    Limitation of Benefit Clause

    Suppose two countries, say India and Mauritius are having tax treaty (DTAA) in order to avoid double taxation which will boost investment growth in these countries by incentivising the investors of these three countries. Now, Mr X of another country, say South Africa comes to know about this. Mauritius is a tax haven and he wants to invest in India. So, instead of directly investing in India from South Africa, he shows that he is investing from Mauritius. Now, according to DTAA, he will be able to avoid taxation in both South Africa and India and pay taxes according to tax rates in Mauritius. Tax rates are much lower in Mauritius and hence he will be able to lessen his tax burden. However, governments will face revenue shortage because of this.

    TREATY SHOPPING : It is the term used for exploitation of tax treaties between two nations by individual/company of any third nation in order to avoid taxes.

    Hence, India came up with Limitation of Benefit Clause. Under LoB, foreign investors who seek tax exemptions in India should produce documents that he is a resident of the said foreign country (eg Mauritius). LoB refers to procedural requirements that the concerned beneficiary is a resident of the treaty country. The Limitation of Benefit (LoB) Clause is attached by the treaty parties in their bilateral DTAAs. The benefit of tax concession will be limited to such entities that produces the document (for example, the company proving that its residence is in Mauritius).

    GAAR (General Anti Avoidance Rules) will not be applied to those firms who satisfies the above mentioned conditions under LoB clause (concerned beneficiary is a resident of the treaty country).
