2. 20 memebrs
3. 3/4th to be ST and not Representative of ST
( As I understand )

No

But it says “To take care of the welfare of the scheduled tribes, a Tribal Advisory Council is constituted in each state with a scheduled area.”
Also it says: The Scheduled areas can be established under Article 244 and 5th Schedule of the Constitution in any state except Assam, Meghalaya, Tripura and Mizoram.
“Each” state means it is established in ”Each” state. The language of it forces the interpretation to ”only”
Point 1 does not mention ONLY . It just mentions that – ‘A Tribes Advisory Council is established in each state having scheduled areas to advise on welfare and advancement of the Scheduled Tribes.’ There is nothing wrong in it.
Read carefully, it can be established in areas other than 5th schedules areas.
if the President so directs, also in any State having Scheduled Tribes but not Scheduled Areas
Yes but it also says TAC can only be established in 5th Schedule Areas. Therefore point 1 of q5 is clearly wrong. Answer should be (3) only.
Removal of VP takes place by EFFECTIVE majority. At one place in Lakshmikanth, type of majority is wrongly mentioned !!
wat,s the correction of vice prez impeachment ?
can u share ur strategy???
Yes !!!
sir,do u clear prelims last year??
Good question 🙂
4. Tribes Advisory Council.-(1) There shall be established in each State having Scheduled Areas therein and, if the President so directs, also in any State having Scheduled Tribes but not Scheduled Areas therein, a Tribes Advisory Council consisting of not more than twenty members of whom, as nearly as may be, three-fourths shall be the representatives of the Scheduled Tribes in the Legislative Assembly of the State:
Provided that if the number of represenatives of the Scheduled Tribes in the Legislative Assembly of the State is less than the number of seats in the Tribes Advisory Council to be filled by such representatives, the remaining seats shall be filled by other members of those tribes.
2/5,
Q2,4,5
When the same person is appointed as the governor of two or more states, the emoluments and allowances payable to him are shared by the states in such proportion as determined by the President but the question says Parliament.
Doubt, What if a state does not even has 3/4 of 20 members as MLAs. The number of ST MLAs is even less than 3/4 of the sanctioned strength of the Council.
, 3/5

Mistake in 2nd question.Answer should be “D”
Thanks!
you are correct, it should be not more than 20 members as per DD Basu.
CSE2017 aspirant (ABG),
We can refer constitutional words.and fifth schedule…not more than 20 members.
Atb.. keep it up
haha…true, but most trusted of all sources in most of the cases except few like u mentioned…isn’t it?
Lakshmikanth can be wrong
It says, Locus standi is not necessary only in case of Quo Warranto, but in reality – Habeas corpus also does not require locus standi
It mentions impeachment process of Vice President wrongly at one place.
So, we need to be careful while going through Lakshmikanth also !!!
He needs to be first removed from the office and then criminal proceedings can be instituted against him.
Governor’s office is associated with dignity of the state. Similarly, it will not look good if criminal cases are instituted against president.
Hence, during his office term , he is immune, not after that !!!
yes, this is what is written in Laxmikant. This is same for President too. no criminal proceeding while in office even in respect of his personal act like murder.
3/5..Thanks team
laxikant says the later. so will go by it.
This Tribal Advisory Council will be made of maximum 20 members out of which the three-fourth will be Scheduled Tribes MLAs in the state.
http://www.gktoday.in/blog/fifth-schedule-scheduled-areas-and-tribal-advisory-council-in-india/
Explanation says it is to consist of 20 members. Which one is right – is it maximum of 20 members, or exact 20 members ?
If a governor commits murder during his term, can he be tried for his personal act when he’s done being governor?
yes, PRESIDENT and PARLIAMENT makes a LOT of DIFFERENCE !!!
2/5
there is a problem with 1st option not the 2nd
3/5
Sir the question Option reads “PARLIAMENT”!!
Good job 🙂
In question it is parliament
For further clarity –> I come from Madhya Pradesh which has long been (in)famous for Vyapam Scam. You can find an article on Vyapam in today’s Hindu as well.
During the investigation, the CBI found that there is evidence indicating the role of the Hon. Governor (Ram Naresh Yadav). The Evidence was produced in the Supreme Court and the Court initially erred in hearing the arguments against him. Later it realised that under the provisions of the Constitution (Article 361), the Governor IS ”IMMUNE” from any criminal proceedings including for his personal acts.
His son was found ‘dead’ in his Lucknow residence.
This story will help you all in remembering that the Office of Governor is immune.
When the same person is appointed as the governor of two or more states, the emoluments and allowances payable to him are shared by the states in such proportion as determined by the President.
