However, I’ve doubt. Since, in the question ForumIAS has asked to critically analyse, I think 1-2 points of drawbacks for consequences of criminalizing marital rape is required. Example: False cases and harassment of dues against husband.

Not to sound rude but what perplexes me is that how will u prove marital rape? who will be the witness? what evidence will be taken into account?
eg a couple in a metro living together with no elders or kids.
Women wants to file a marital rape case. what is the evidence she has? only oral statement is enough????
I am for a marital rape law but do no find answer to my question.

To live a life with dignity comes under the purview of Art. 21 of the Indian Constitution, but law is silent on the issue of Marital Rape. According to Section 375 (Exception 2) of IPC, the intercourse of a husband with his wife above the age of 15 is not considered rape. Also Section 498 covers domestic violence but has no provision on marital rape. This reluctance of law coupled with patriarchy family culture & social stigma attached with discussion of sexual relations post-marriage results in the under-reporting of the incidents of marital rape. Therefore there is a dire need of reforms such as:
• Review the blatantly outdated Exception 2 of Section 375 (as marriage of girl under 18 yrs. of age is already illegal) to bring Marital Rape under IPC.
• Law should ensure the rehabilitation & safety of victim and her children.
• Specific guidelines on medical assessment of physical as well as mental trauma faced by the victim.
• Awareness campaign should be run by Govt. and NGOs encompassing cities as well as villages.
However, misuse of such laws dilutes the main purpose. While framing law against marital rape, Govt. should make sure that it doesn’t become another tool to victimize males as reported in many cases under Section 498.
