It is not meant to impose one conception of the good life, and its authority rests on consent, not force.<\/p>\n<p><span class=\"n-term\">Main features<\/span><\/p>\n<ul>\n<li>Limited jurisdiction \u2014 the state cannot trespass beyond its proper field; it is not supreme in every sphere.<\/li>\n<li>No punishment without proven fault; action must follow law and proper procedure (<span class=\"n-term\">rule of law<\/span>).<\/li>\n<li>Multiple power centres \u2014 <span class=\"n-sch\">Montesquieu<\/span>&#8216;s separation of powers prevents absolutism.<\/li>\n<li>Limitation of power \u2014 <span class=\"n-sch\">Lord Acton<\/span>: \u201cPower corrupts and absolute power corrupts absolutely.\u201d<\/li>\n<li>Individual rights, a reformist temper, competition of ideas (<span class=\"n-sch\">J. S. Mill<\/span>: truth emerges from the struggle of opinion), and flexibility \u2014 no single fixed form, but constant principles of rights, limited power, rule of law, freedom and accountability.<\/li>\n<\/ul>\n<p><span class=\"n-term\">From Machiavelli to Mill<\/span><\/p>\n<p><span class=\"n-sch\">Machiavelli<\/span> &amp; <span class=\"n-sch\">Bodin<\/span> raised the early questions of origin, authority and interests. <span class=\"n-sch\">Hobbes<\/span> (<em>Leviathan<\/em>): the state cures the disorder of a life \u201cnasty, brutish, and short.\u201d <span class=\"n-sch\">Locke<\/span>: the state protects life, liberty and property, is limited and consent-based \u2014 \u201cGovernment has no other end but the preservation of property.\u201d <span class=\"n-sch\">J. S. Macpherson<\/span>) \u00b7 communitarian (<span class=\"n-sch\">Michael Sandel<\/span>, <span class=\"n-sch\">Michael Walzer<\/span>, <span class=\"n-sch\">Charles Taylor<\/span>).<\/p>\n<p><span class=\"n-lab\">Assessment.<\/span> A strong defence of liberty, rights, consent and constitutionalism that limits arbitrary power; its weakness lies in assuming the state can stay neutral among unequal groups \u2014 feminist, Marxist and neo-pluralist critics show class, gender and business power shaping its institutions.<\/p>\n<div class=\"n-pyq\"><span class=\"n-pyq-chip\">UPSC 2022 \u00b7 20m<\/span><span class=\"n-pyq-q\">Examine the liberal theory of State in contemporary politics.<\/span><a class=\"n-pyq-a\" href=\"\/psir\/psir-pyq\/examine-the-liberal-theory-of-the-state-in-contemporary-politics-upsc-psir-2022-0207\/\">Answer<\/a><\/div>\n<h3 id=\"the-liberal-democratic-state\">The liberal-democratic State<\/h3>\n<p>Balances <span class=\"n-term\">liberty and authority<\/span>. The State is coercive, but liberal principles secure individual rights and limit state power. Two elements: the <span class=\"n-term\">liberal element<\/span> (individual rights, limited power, constitutional governance) and the <span class=\"n-term\">democratic element<\/span> (popular rule, elections, representative institutions).<\/p>\n<p><span class=\"n-term\">Foundational thinkers<\/span><\/p>\n<ul>\n<li><span class=\"n-sch\">John Locke<\/span> \u2014 the liberal state rests on the <span class=\"n-term\">social contract<\/span>: government by consent, power limited through majority rule, separation of powers and protection of individual rights.<\/li>\n<li><span class=\"n-sch\">Charles-Louis Montesquieu<\/span> \u2014 the <span class=\"n-term\">separation of powers<\/span> (executive, legislature, judiciary) as a check on abuse.<\/li>\n<li><span class=\"n-sch\">Thomas Paine<\/span> \u2014 representative democracy, manhood suffrage and rights against oppressive governance (French Revolution).<\/li>\n<li><span class=\"n-sch\">Mary Wollstonecraft<\/span> \u2014 critiqued patriarchy; women\u2019s equal rights and representation.<\/li>\n<\/ul>\n<p><span class=\"n-lab\">Features<\/span>: a <span class=\"n-term\">limited state<\/span> (constitutional constraints securing justice and liberty) where the <span class=\"n-term\">rule of law<\/span> prevails and government rests on consent and on <span class=\"n-term\">trust<\/span> between governors and governed.<\/p>\n<h3 id=\"the-english-utilitarians-and-the-state\">The English utilitarians and the State<\/h3>\n<ul>\n<li><span class=\"n-sch\">Jeremy Bentham<\/span> \u2014 the <span class=\"n-term\">principle of utility<\/span>: the State\u2019s legitimacy rests on maximising happiness for the greatest number. His <span class=\"n-term\">Constitutional Code<\/span> drafted a model of parliamentary democracy \u2014 annual elections, equal electoral districts, abolition of monarchy, civil-service examinations for accountability.<\/li>\n<li><span class=\"n-sch\">James Mill<\/span> \u2014 built on Bentham; advocated universal suffrage to keep governments accountable.<\/li>\n<li><span class=\"n-lab\">Post-reform<\/span> \u2014 the <span class=\"n-term\">Reform Act of 1832<\/span> reshaped British democracy, improving responsiveness and extending the franchise.<\/li>\n<\/ul>\n<h3 id=\"from-classical-liberalism-to-welfare-liberalism\">From classical liberalism to welfare liberalism<\/h3>\n<ul>\n<li><span class=\"n-sch\">Leonard Hobhouse<\/span> \u2014 redefined liberty beyond <span class=\"n-term\">freedom from interference<\/span> to include <span class=\"n-term\">positive welfare<\/span>; the State must secure <span class=\"n-term\">distributive justice<\/span>.
