States have no separate constitutions or citizenship; a uniform parliamentary model; the Governor as nominal head; the CM and Council as the real executive; an integrated judiciary; Centre&#8217;s influence through Arts 249, 257, 356 and emergency provisions.<\/p>\n<p><span class=\"n-term\">Articles: 153<\/span> (Governor for each state), <span class=\"n-term\">154<\/span> (executive power), <span class=\"n-term\">155<\/span> (appointment by President), <span class=\"n-term\">156<\/span> (pleasure of President), <span class=\"n-term\">157<\/span> (qualifications), <span class=\"n-term\">159<\/span> (oath), <span class=\"n-term\">161<\/span> (pardon), <span class=\"n-term\">163<\/span> (aid, advice &amp; discretion), <span class=\"n-term\">164<\/span> (CM &amp; ministers), <span class=\"n-term\">200<\/span> (assent\/reservation), <span class=\"n-term\">213<\/span> (ordinances), <span class=\"n-term\">356<\/span> (report on breakdown).<\/p>\n<blockquote class=\"n-quote\">\n<p>The office of Governor is &#8220;acutely controversial&#8221;.<\/p>\n<p><cite>Granville Austin<\/cite><\/p><\/blockquote>\n<blockquote class=\"n-quote\">\n<p>The Governor is &#8220;a Constitutional sentinel and a vital link between the Union and the State.&#8221;<\/p>\n<p><cite>Sarkaria Commission<\/cite><\/p><\/blockquote>\n<blockquote class=\"n-quote\">\n<p>&#8220;He is the representative not of a party; he is the representative of the people as a whole of the State. It is in the name of the people that he carries on the administration.&#8221;<\/p>\n<p><cite>B.R. Ambedkar<\/cite><\/p><\/blockquote>\n<p><span class=\"n-sch\">B.R. Ambedkar<\/span> also held that the Governor &#8220;has no functions which he can discharge by himself&#8221; and must follow ministerial advice in all matters. <span class=\"n-term\">Appointment debate:<\/span> the Assembly rejected an elected Governor (a direct mandate could clash with the elected ministry; risk of rival authority; need for a Union link); <span class=\"n-sch\">K.M. Panikkar<\/span> and <span class=\"n-sch\">H.N. Kunzru<\/span> feared the Governor might become an agent of the Centre.<\/p>\n<p><span class=\"n-term\">Powers:<\/span> <em>Executive<\/em> \u2014 appoints CM and ministers, Advocate General, SPSC members; Chancellor of state universities; governs during President&#8217;s Rule. <em>Legislative<\/em> \u2014 summons\/prorogues\/dissolves the legislature; assents to\/returns Bills; reserves Bills for the President; ordinances. <em>Financial<\/em> \u2014 recommends Money Bills; Contingency Fund advances; State Finance Commission. <em>Judicial<\/em> \u2014 pardon under Art 161 (not death sentences, unlike the President); appoints district judges in consultation with the High Court.<\/p>\n<p><span class=\"n-term\">Removal:<\/span> Art 156 \u2014 holds office during the President&#8217;s pleasure. In <span class=\"n-law\">B.P. Singhal v. Union of India<\/span> (2010): the Governor is not an employee of the Centre; removal cannot be arbitrary or mala fide; reasons need not always be disclosed but a valid reason must exist. The <span class=\"n-term\">Sarkaria Commission<\/span> urged that a five-year tenure not be disturbed except for rare and compelling reasons; the <span class=\"n-term\">Punchhi Commission<\/span> criticised the arbitrary pleasure doctrine and recommended an opportunity to defend the position.<\/p>\n<h3 id=\"governor-s-discretion-recent-role\">Governor&#8217;s Discretion &amp; Recent Role<\/h3>\n<p><span class=\"n-term\"><span class=\"n-law\">Article 163<\/span><\/span> allows discretion only where the Constitution requires \u2014 not general; it must be reasoned, cautious, in good faith and constitutionally limited. <span class=\"n-term\">Main areas:<\/span> appointment of CM in a hung Assembly (<span class=\"n-sch\">H.M. Seervai<\/span> warns that inviting a minority group first can help it attract defectors through ministerial promises); the floor test (<span class=\"n-term\">S.R. Bommai<\/span> requires a floor test, not subjective assessment); dismissal of a ministry that has lost majority and refuses to resign (<span class=\"n-sch\">M.V. Pylee<\/span> \u2014 justified if the CM compromises national unity); reservation of Bills (Art 200); President&#8217;s Rule report (Art 356); legislative sessions where the CM avoids the Assembly; special responsibilities (<span class=\"n-law\">Sixth Schedule<\/span>, Arts 371A\u2013H).<\/p>\n<p><span class=\"n-term\">Cases narrowing discretion<\/span><\/p>\n<ul>\n<li><span class=\"n-term\">Samsher Singh<\/span> (1974) \u2014 generally acts on ministerial advice \u00b7 <span class=\"n-term\">S.R. Paul&#8217;s President&#8217;s-Rule recommendation before a trust vote, overturned by the High Court; <span class=\"n-term\">Goa (2017)<\/span> \u2014 Mridula Sinha invited the BJP coalition though Congress was single largest; <span class=\"n-term\">Manipur (2017)<\/span> \u2014 Najma Heptullah invited the BJP first; <span class=\"n-term\">Karnataka (2018)<\/span> \u2014 Vajubhai Vala gave a long period to prove majority, shortened by the Supreme Court, Yeddyurappa resigned before the floor test; <span class=\"n-term\">Maharashtra (2019)<\/span> \u2014 Bhagat Singh Koshyari&#8217;s President&#8217;s-Rule recommendation and an early-morning swearing-in; <span class=\"n-term\">Tamil Nadu<\/span> \u2014 delay in assent; <span class=\"n-term\">West Bengal<\/span> and others \u2014 public confrontations raising questions of constitutional morality.<\/p>\n<p><span class=\"n-sch\">A.G. Noorani<\/span> traces the office partly to colonial Section 93 of the Government of <span class=\"n-law\">India Act, 1935<\/span>; <span class=\"n-sch\">Rajni Kothari<\/span> saw the Governor as a potential instrument of the Centre; <span class=\"n-sch\">Granville Austin<\/span> warned that partisan actions weaken federal autonomy; <span class=\"n-sch\">Subhash Kashyap<\/span> argues the Governor should be discreet and dignified; <span class=\"n-sch\">Sujit Choudhry<\/span> supports clearer guidelines and inclusive selection.<\/p>\n<blockquote class=\"n-quote\">\n<p><span class=\"n-term\">UPSC 2015 \u00b7 \u2014<\/span> \u00b7 <span class=\"n-term\">UPSC 2016 \u00b7 15m<\/span> \u2014 Discretionary powers of the Governor \/ role in recent times. (2015 marks not stated in source.)<\/p>\n<\/blockquote>\n<h3 id=\"chief-minister-state-council-lieutenant-governors\">Chief Minister, State Council &amp; Lieutenant Governors<\/h3>\n<h4 id=\"chief-minister-state-council-of-ministers\">Chief Minister &amp; State Council of Ministers<\/h4>\n<p>The CM is the real executive head; the Governor appoints the leader commanding an Assembly majority. <span class=\"n-lab\">Functions:<\/span> forms the ministry, allocates portfolios, leads the Council, coordinates administration, communicates with the Governor, manages the majority, interacts with the Union. In national parties the high command often influences selection; regional parties allow stronger local choice (Tamil Nadu, UP, Bihar). <span class=\"n-sch\">Balveer Arora<\/span> and <span class=\"n-sch\">R.L. Goyal<\/span> note the Union often influences removal through the Governor. <span class=\"n-term\">Tenure:<\/span> office during the Governor&#8217;s pleasure, but practically only while enjoying a majority (<span class=\"n-term\">S.R. Bommai<\/span> \u2014 floor test). <span class=\"n-term\">Developmental role:<\/span> CMs shaped Five-Year Plans through the National Development Council. The Council is collectively responsible to the Assembly; in practice caste\/region\/religion and coalition balance shape it; a strong CM can reduce the Council to a rubber stamp, a weak majority empowers ministers.<\/p>\n<h4 id=\"lieutenant-governors\">Lieutenant Governors<\/h4>\n<p><span class=\"n-lab\"><span class=\"n-law\">Article 239<\/span><\/span> \u2014 Union Territories are administered by the President through an Administrator; the LG is an administrator, not a state constitutional head (Delhi, Puducherry, Andaman &amp; Nicobar).<\/p>\n<p><span class=\"n-term\">Governor<\/span><\/p>\n<ul>\n<li>Head of state \u00b7 Part VI \u00b7 acts generally on the Council&#8217;s advice \u00b7 limited discretion under Art 163.<\/li>\n<\/ul>\n<p><span class=\"n-term\">Lieutenant Governor<\/span><\/p>\n<ul>\n<li>Represents the President in a UT \u00b7 Centre has a stronger role \u00b7 powers vary by UT.<\/li>\n<\/ul>\n<p><span class=\"n-lab\">Delhi: Article 239AA<\/span> \u2014 the Assembly cannot legislate on <span class=\"n-term\">public order, police and land<\/span>; the LG has a greater role on these.
