According to PIB of 22nd July, 2019 Judge of Supreme Court is also made eligible for Chairman of NHRC. no mention of retired or serving.

Test: 12, Q:18...

So, why answer is C????

, It says who "has been" judge of SC.

So that has to be retd. only, and not serving.
