Triple talaq- An issue of genderequality not religion
The word talaq stands for divorce in Arab language. Triple talaq is the declaration of divorce by the male associate of a married couple to a woman by simply pronouncing the word ‘ talaq’ three times in one sitting.
The pronouncement of the word can take place even with the help of electronic media using messages mails or through telephonic conversations irrespective of the fact the wife is physically around the husband. The man may not cite any cause for the divorce or lend any valid reason for the same to his wife. After the period of iddat, during which it is ascertaind whether the wife is in her pregnancy period , the divorce becomes irrevocable.
The wife can remarry her husband only after the process called nikah halala, which says the wife has to marry the other person before going back to her previous husband.
ROOT CAUSE
1).The Muslim laws in India are governed by Muslim personal law( shariyat) 1937 which are based on the teachings of ulama ( a class of Muslim scholars).The ulama themselves consider this form of divorce binding provided the announcement is made in front of Muslim witnesses and later conformed by shariat court. The only recommendation it provides is that the pronouncement of word ‘talaq’ thrice should occur each time with the specified time interval of minimum one month.
2). Moreover ,the AIMPLB( All India Muslim People Law Board) defends this practice by claiming that it has received around 3.5 crore forms from Muslim women across the country support in the triple talaq.It also propgates the false fact that the mu slim community has relatively very less cases of divorces in comparison to other religious communities.
OPPOSITION
It has faced opposition from a large number of Muslim women who have even filed a PIL in the supreme Court of India for the revocation of the same.
2) they have asked for the scrapping for the same by advocating that the shatiat law confronts the article 14 of the Indian constitution.
CONCLUSION
It should be very genuinely understood that all the laws , articles made by the highly esteemed people of the particular religious bodies or the government bodies of a country should be in the attempt of providing a secure, livable and health environment for all the beings of the society without any discrimination being done on the basis of caste ,creed or gender. Enforcement of provisions such as that of triple talaq ,nikah halala etc by being in line with the majoritarians of the community may be gender wise or any other basis is not at all accepted by the people who hail themselves of being the true guardians of the masses
