    That mean is generally binding and stand reiterated in number of cases.

    If there is word “In all case” in statement 2 than it may be wrong but generally its right.

    Can anyone throw a light on question no.1 regarding parliament power to implement any international treaties. My question is does it include J&K?
    + question 5, about governor; although i never see such a provision in the const.,suppose if the COM tendered a notice to the governor,will it be binding on the governor?

    I think relying on basics is better than on authentic sources – this will help in solving any other question asked in UPSC. Not only equilisation levy, but any other example of taxes !!!
    Question may also come – why it is DIRECT tax and not INDIRECT tax. Can be asked in interview too. So, authentic sources are fine if one is dealing with factual things, not for such things which can be solved by analysis !!!

    I never thought about it before you asked this question
    When I started writing answer – I thought it is INDIRECT
    When I was thinking about the reasons – who is liable to pay and on whom does burden to pay tax falls, I suddenly realised that according to this basic definition, it should be DIRECT tax.
    And, at last – I forgot to change the one word answer mentioned on top from INDIRECT to DIRECT ๐Ÿ™‚ (CORRECTED now)

    Yehi to difference hai President and governor ke respect main

    President – It is mentioned in the constitution or say in 42nd CA – that advice of CoM is binding on president
    There is nothing like such mentioned in constitution which makes advice tendered by CoM of state binding on the Governor.

    Note: It is being mentioned in chapter on ‘Governor’ in Lakshmikanth !!!

    What happens is the firm which has used the google or any online site for advertising needs to pay equilisation levy.

    The term โ€œEqualization Levyโ€ colloquially called โ€œGoogle Taxโ€ had made its first appearance in this yearโ€™s budget documents. The Government has put a 6% equalization levy on the income accrued to a foreign E-commerce company which is not a resident of India. This would affect Google, Amazon, Facebook etc.

    Any person or entity which makes a payment exceeding Rs 1 lakh in a financial year to a non-resident technology company for some B2B {Business to Business Services} needs to withhold 6% tax on the gross amount being paid as an equalisation levy.

    It is a tax to equalize the tax burden on remote and domestic suppliers of similar goods and services. The objective of this tax is to make sure that those entities making a payment to a non resident for specified services like online advertisements to deduct this tax before making the payment.

    On Whom The Equalization Levy Is Levied?

    The levy will be applicable on the payments received or receivable by a nonresident service provider not having a permanent establishment (PE) in India from an Indian resident or an Indian PE of a nonresident with respect to the specified services offered. The levy would not be applicable to nonresident service providers having a PE in India.

    Basically, non resident e-firms providing services are being taxed. But, the buyer here has to deduct the tax, instead of service provided. It means, tax though levied on the seller of the service here is being deducted and paid by buyer.

    What is the basic difference between direct and indirect tax ?

    The basis of classifying taxes into direct and indirect taxes is โ€œwho ultimately bears the burden of a tax.โ€

    When (i) liability to pay a tax and (ii) the burden of that tax falls on the same person, the tax is called a direct tax.

    Liability to pay a tax = Buyer.
    Burden of that tax = Buyer.

    So, it will be a DIRECT TAX according to me.

    When (i) liability to pay a tax is on one person and (ii) the burden of that tax falls on some other person, the tax is called an indirect tax.
