@upsc2020 was secular term originally present in the constitution?
I think it was present in the 'constitution' before the 42nd aa. The word has been mentioned in Article 25 (2).
However in the 'preamble' it was added by 42nd aa.
I have a doubt regarding the Waman Rao case and Coelho case.
What i understand is -
Waman Rao case 1981 reiterated that thebasic structure doctrinewould be applicable for the laws made post April 23rd 1973 (Kesavanand bharti case) This would mean basic structure doctrine is applicable only for post April 23rd 1973 amendments and not for the ones made before this date.
And Coelho case 2007 says - anything put under 9th schedule post April 23,1973 would beunder Judicial review.
Is this interpretation correct?
Also - If the laws put under schedule 9 are anyways subject to judicial review then what is the point of putting them in that schedule in the first place.
Can the president of India deny his assent to a bill?
Yes he can do that. Mainly under two circumstances -
1. in case of private member bill
2. public bill passed by both the houses but before the president assent - the new govt comes up. In such case - if the new govt. asks the president to deny the assent then he has to.
This aspect is also covered under article 74 thus this denial is not discretional i think.
which department is mandated to identify the PSU for disinvestment? is it DIPAM or NITI Aayog?
@Casablanca NITI snt a dept so can advise on evey othr issue.
Yes@Agog , but here in the article niti is given specifically the work to identify the PSUs for disinvestment.
However the article also says - the identification is now jointly by DIPAM and NITI.
https://economictimes.indiatimes.com/news/economy/policy/cabinet-approves-new-strategic-disinvestment-process/articleshow/71445908.cms#:~:text=While%20presently%20PSUs%20for%20strategic,for%20strategic%20disinvestment%2C%20they%20said.
My confusion is, for a question like the one below, what should be the answer -
Q.22) Which of the following has been mandated to identify PSUs for strategic disinvestment
a) Department of Investment and Public Asset Management (DIPAM)
b) NITI Aayog
c) Cabinet Committee on Economic Affairs
d) Union Ministry of Commerce
Communal electorate for Anglo Indians was introduced by goi act 1919?
An Indian express article says the term Anglo Indians was first used in GOI Act 1935.
Thanks@sjerngal for responding.
This article also says it provided for separate electorate for Muslims. But we all know that was first introduced in 1909.
My doubt being - were Anglo Indians first given the separate electorate in 1919 (as given in lakshmikant) or is it in 1935 as the article says.
Is Vice President part of parliament?NO
Why?
Wouldn't ex officio Rajya Sabha chairman be part of parliament?
Yes, He is a member of parliament as ex officio chairperson.
In the constitutional set-up, the holder of the office of Vice-President is part of the Executive but as Chairman of the Rajya Sabha he is a part of Parliament. He has thus a dual capacity and holds two distinct and separate offices.
https://rajyasabha.nic.in/Chairman-Rajyasabha/Ex-officio-position.htm
I guess not. Since you're including the upper house in parliament, it automatically assumes the RS chairperson as its part.
I think here its about the post capacity. If question mentions the post VP - then he isnt the part of parliament. But when it specifically mentions chairman of RS - then he is a part of parliament.
The official website also mentions these two to be completely different and separate postings.
Why polar vortex is called a low pressure zone?
An increase in temperature contributes to the lowering of the pressure in the stratosphere. Force of vortex pushes the air counterclockwise towards the pole.
Thanks. Also when we talk about polar vortex - it is stratospheric phenomena. NOt the ground one. Pole itself has HP. Polar vortex is LP counterclockwise movement of wind over and above the poles?
Am i understanding it right?
@Casablanca Cold Air - - heavy dense - - low pressureHot air - - light - - - high pressureSo pole are cold.. So the pressure will be low
I also think you have mixed up.
Cold air---Particles close----dense--- HP
Warm air--- particles expand--- less dense--- LP
Just 3 clarifications
1. Habitat Rights to PVTG are granted by Tribal Affairs ministry under FRA, irrespective of anywhere they are...inside a national park, WS or tiger reserve?
2. Home Affairs ministry decides categorization of PVTG?
3. Critical Tiger Habitat is defined under WPA while Critical Wildlife Habitat is defined under FRA. Whats the implication of this statement?
Wrt 3rd statement -
Critical tiger habitat - declared under WPA - CTH is Part of tiger reserves- In consultation with subject experts (no gram sabha role) - mainly focusing on tiger conservation.
Critical wildlife habitat- under FRA - CWLH is a Part of WLS Or NP - mandatory consultation with gram sabha and affected people required - focused on wildlife conservation (not only tigers)
Forest rights for habitation/livelihood not allowed in CTH. But the recent issue was Mankidias of Simlipal TR - collect siali from the CTH region of the TR. now that right is being denied to them under the WPA.
It's an issue of overlapping of rights provided under FRA and what WPA says I think.
