Right to work is a necessary imperative all over the nation, rural and urban, not just in these uncertain times but also in the long run. Analyse.
Indian Constitution does not explicitly recognise the ‘right to work’ as a fundamental right. It is placed in Part IV (Directive Principles of State Policy) of the Constitution under Article 41, which hence makes it unenforceable in the court of law. Despite the absence of an express wording of the ‘right to work’ in Part III (Fundamental Rights) of the Constitution, it became a ‘fundamental right’ through a judicial interpretation. Supreme Court through its judgement in Olga Tellis & Ors. v Bombay Municipal Corporation & Ors.- ‘right to work’ was recognised as a fundamental right inherent in the ‘right to life’.
All these grave consequences faced by the poor of the country are the result of the lack of proper provisions in the labour laws or other laws relating to the right to work. The measures in the mentioned laws do not consist situations such as pandemics under its purview. Due to the lack of which, the migrant workers are forced to return to their homeland.
Idea of a country with hundred percent employment is well embedded in the Constitution. The government should make every citizen eligible enough to survive through times like these. The various laws protecting the right to work must be amended from time to time to suit the present times and work accordingly.

Balanced view : Have guidelines instead with standard system of age ratings. Encourage self regulation. Also push OTT platforms to have parental controls for using apps.
