(b) A politically organized people of a definite territory and possessing an authority to govern them, maintain law and order, protect their natural rights and safeguard their means of sustenance


why not a 

1. A Community (a nation can have to be a community but state can have many communities. ex Indian state , American state both have heterogeneous communities)

2. Permanently living from long time ( It is not required whether they are permanently living from long time or not for creating and maintaining state 

For ex - Israel ) 

Baaki aur bhi hai a to hoga hi nahi.


why B

2. Definite territory ( yes .. mandatory because ..state is up to there up to where its writ being accepted by people in a territory  . As per loose concept of nation can be in 2 or 3 states based om situation for ex Irish people. But nation state is where community and government both have same alignment  ) 

3. Authority - Most basic and very important feature. There can ne no state without presence and exercise of authority.

4. rest of all are self explanatory

Is  dominion state not a state? Because it is not sovereign?

I have not talk about sovereignty .. read again


dominian state have all features which B option provides. 

The only difference is it does not have sovereignty.

Like british india - Can you say it satisfied any criteria given in all 4 options accept B. 

In option B - Sovereignty is no where mentioned. 

Even a Dominion state is politically organized have authority and a fix territory and have some duties and rights.

A 32 is correct. The question is about when *subject matter of legislation is itself overarching* 

A14- It is about application of law per se. Second , The subject matter can be challenged on the ground of irrational classification. 

A32 - Subject matter of any law which violates any FR can be challenged under it. 


In the statement *discretion to the administrator and unlimited power to bureaucrat* tramples on right to freedom , right to equality or any FR per se because if Administrator has unregulated descretion in decision making - He is ready to make decision legally which ay hamper any FR. 

So, Impact analysis of such law tells that - The problem is in subject matter of law which may led to violation of any FR  due to any irrational decision coming out of administratorial descretion. 

So , It is Article 32.

 Article 32 is not constraining Administrators , it's just a tool to operationalise the Rights and gives them teeth. Article 32 is violated when Parliament takes away Judicial Review powers, not when administrators act arbitrarily. Discretion = Arbitrariness = unequal application of law= no equality before law or equal protection of law.




Go and read chapter on FR of Constitution at work NCERT. You will figure it out.

Dont refer laxmi basu or any xyz coaching. You will get more confused. 

also, If you read newspapers daily and focused on court decisions during corona time where administration got tremendous descretionary power ... court came to rescue (it is the source of this question)

Kurdish people have authority, they administer their own laws, protect their people, they have inhabited those lands for years yet Kurdistan is not a state . why ?
I have also marked B but answer most probably A hoga

Aise to 100 to 100 question have all 4 option right by one or other way. You have to choose most correct.

So can you tell me any other option which is very closely correct to absolute definition of state other than B ?

@D503 Bhai yahan kyun hi bahas karni kisi se yaar. Let it be. Somebody had posted a pdf from a govt university's website from where statement A of definition of state was verbatim lifted (yes, word by word) but still people believe that Option B is the answer. Everyone is entitled to their belief untill UPSC releases the result. For this reason, people claim that their marks have reduced by 30 from UPSC key. Anyway, better would be to focus on mains then these futile discussions. They would anyway come to an end in 10 odd days.

Even I found opt B more correct and marked it as ans. But thn Shubhra Ranjan eliminated this opt bcuz of the term "natural rights". Also Psir ppl are referring to some Montevideo declaration.

Those who are saying "muah Article 32 iz wright" should know that the question asked about the "violation of which article". Vro Article 32 is a remedy of that violation and only if it impinges upon the FRs. Article 14 hai bhai uska answer, ab maan bhi jao.

As u brought Hongkong in picture , Just a simple Google search. There are two types of states  .. sovereign and non sovereign states. 

Sovereignty and state are two individual concepts. when a state is devoid of any external control -It is know as A sovereign state.

Another note - India was a Dominian state till 1950.. than it became sovereign state. However, It was always the STATE.
