OBC Non Creamy Layer related queries while filling UPSC Prelims 2025 DAF

For Example

Q.1 What precautions must be taken by the candidates for claiming OBC reservation before applying for an Examination? (Ans. Candidates seeking reservation/ relaxation benefits available for OBC category must ensure that they are entitled to such reservation/ relaxation in accordance with the eligibility prescribed in the Examination Rules issued by the Government/Examination Notice issued by the UPSC.)


Q.2 Who is competent to issue an OBC certificate?( Ans. OBC certificate should be issued by any of the following authorities:

  • (a)  District Magistrate/Additional District Magistrate/ Collector/ Deputy Commissioner/Additional' Deputy Commissioner/ 1st Class Stipendiary Magistrate/ Sub-Divisional Magistrate/ Taluka Magistrate/Executive Magistrate/ Extra Assistant Commissioner

  • (b)  Chief Presidency Magistrate/Additional Chief Presidency Magistrate/ Presidency Magistrate

  • (c)  Revenue Officer not below the rank of Tehsildar and

  • (d)  Sub-Divisional Officer of the area where the candidate and/or his
    family normally resides

  • (e)  Administrator/Secretary to the Administrator/Development
    Officer (Lakshadweep)

Q.3 Whether Migration Clause/Para should be part of the OBC certificate?(Ans. Migration Clause/Para should be the part of OBC certificate, in case certificate is issued by a State other than that to which his/her father originally belongs.)

Sir, my income certificate is made according to my father basic pay...but sir in form we have to write income from salary then I will write my father gross salary along side with ITR...so sir there is mismatch between my income certificate and father actual salary..so sir will it create problem for me in future...my father is group c employee

Hi, isn't OBC NCL certificate for state govt. Officer is because of there level of service (initial level)?

My father initially started as a lab assistant but now he has been promoted to a teacher and income is above 8L/year. Am I eligible for the OBC-NCL or not?

@Sachinsun Regarding parents under private employment or private business, annual income is the main criterion. Nevertheless, salary and income from other sources should be considered separately.

@akelakrishna2012548 The main point here is to treat income from salary and income from other sources separately. Neither salary nor income from other sources should cross Rs.8 lakhs in three consecutive years.

Check your parent’s salary for the last three consecutive years. If in any of the last 3 years it is below 8 lakhs, you are qualified for OBC Non-creamy layer status, provided income from other sources is also less than 8 lakhs.

Hello sir! My query is i haveobc ncl certificate issued by sdm but they were asking for parents pan card in that sirname of my parents are differnt and in my all documents there sirname is same there is a mis match of sirname  . And second is they r asking total irrigated land area  which is 36 of my parents but in state statutory ceiling limit is 18 acres so what should i do now ? Still i can for obc ncl reservation or not

@Gajju25  Don't worry you can submit. UPSC will give you a time within which you have to submit affidavit regarding change of name in your certificate.

Actually I have applied for caste certificate for OBC NCL based on annual income,with proof of income certificate 2023-24 and not that of last three years and  ITR is not applicable as income that if my family is meager.

So what should I do now, will it create any issue?

@MonikaSoni  Regarding parents under Government employment, the status of the job (Group A/B/C/D) is more important than the salary. If your parents are earning more than 8 lakhs but their rank is below that of group B officers, you will still come under the Non-Creamy Layer.

@Gannuu   Regarding parents under Government employment, the status of the job (Group A/B/C/D) is more important than the salary. If your parents are earning more than 8 lakhs but their rank is below that of group B officers, you will still come under the Non-Creamy Layer. You should write on the basis of ITR.
