- Freedom of Speech and Expression through the medium of internet is an integral part ofArticle 19(1)(a).
- Freedom of trade and commerce through the medium of internet is also protected underArticle 19(1)(g).
- Any order suspending the internet has to be subjected to theprinciple of proportionality, backed by reasons and should be for alimited timeframe.
- Doctrine of Proportionality, as held inAnuradha Bhasin requires:
- 1) the state to show that the basic aim the state seeks to achieve islegitimate.
- 2) the state must demonstrate that it has chosen the"least restrictive" measurepossible to achieve its objective.
- 3) the state must establish that there exists arational nexusbetween the limitations exposed and its purported aim.
NOTE: Supreme Court hasn't expressed its views on whether the right to access internet itself is a fundamental right or not; it has protected theright to use internet as a mediumfor the fulfilment of fundamental rights.
