Official: SFG / RLG All Tests Discussions in one place

Hello All,

The Group usage here is a little cumbersome, so I am creating this thread to make sure that all questions with doubts stay in one place. Can someone push all the doubts and queries here? I will make this an announcement?

SFG/RLG Batch 2 : Test 2, Question no. - 27

As asked even earlier by many people -

Can 'Division of powers' be considered a feature of Presidential system ?

Isn't it a federal feature ?

Why should it not be considered as feature of Presidential system? Federal can have both Presidential and Parliamentary system. Division of power is equally a feature of both. Isn't it?
If you have to compare, compare federal vs union. Not federal vs presidential

But if we talk in general Recall is also an instrument used in presidential system,it was used in usa to Recall the elected governors of certain states.

test 3....question 10....Even though DPSPs are not enforceable by court...as per article 37 they are fundamental in governance and it is the duty of govt to apply these principle in making laws....by this it somehow tries to limit the legislative and executive function of the government?

Please explain Q. 10 ( dpsp constitute limitations upon? )

Dpsp are instructions (not limitations)to legislative n executive.

Dpsps are fundamentals to be followed in governance.

FRS are limitations on both executive n legislative.

Thanks .

Test 3, Q17

Statement 1: Sec. 3 of First Constitutional amendment substituted 19 (2) withRetrospective effect. It reads

Amendment of article 19 and validation of certain laws.-(1) In

article 19 of the Constitution,-

(a) for clause (2), the following clause shall be substituted, and the
said clause shall be deemed always to have been enacted in the
following  form, namely:---

"(2) Nothing in sub-clause (a) of clause (1) shall affect the
operation of any existing law, or prevent the State from making any
law, in so far as such law imposes reasonable restrictions on the
exercise of the right conferred by the said sub-clause in the
interests of the security of the State, friendly relations with
foreign States, public order, decency or morality, or in relation to
contempt of court, defamation or incitement to an offence.";

Thus, it can be construed public order as a reasonable restriction does form a original part. which makesstatement 1 wrong.Contrary, "thesovereignty and integrity" was added by Sixteenth amendment and is not a original part of the constitution

@Yashrajsillodkardoctrine of essentiality is related to Right to freedom of Religion not Right against Exploitation. Thus, statement 3 is wrong.

@Thinker can you please explain the options of Q 18.

My explanation- although the First two elements of rule of law are applicable to the Indian system, but A 14 in itself contains only the second element(Equality before law) and element 1 may be applicable but not under A14.

No option should be correct thus.

How does martial law affect centre state relations?

And also article 32 has been called heart and soul by Ambedkar and not preamble. Please review question 23 and 8.

@Thinker can you please explain why the answer to Q18 is b, not C (test 3).@Patrick_jane

For statement 1)Bcoz in India we have Rule of law as basic structure which act as limitations on Arbitrariness of Legislative/executive.

Statement 3)is incrct bcoz in our constitution Article 14 has Equal protection of laws which has equality of treatment underequalcircumstances.

option gaveeverycircumstances.

So B is crct answer

Q8 correct answer should be b instead of a

Q18 correct answer should be d instead of b

Please clarify it

Q8 ka ans should be b

And about 18 I think the right ans is b only... coz second provision of a14 states that equality of treatment under equal circumstances
