L2T2- 68.67 38:11:1

Note to self:

read the question twice

L1T3-

1. Confusion b/w 42nd and 44th AAs. 44th removed RTP, not 42nd

2. Article 19 all the rights in this are against the state only.

3. Specific differences between Prohibition and Certiorari

4. Not reading each word in the question->Eq of status "preamble"

5. Read the question again after deciding the answer. ->helped in two questions

1.      Procedure established by law-India, Due process of Law- US (ashamed as a lawyer)

2.      Harm theory- constrain                 on person to not harm other, right to freedom- speech>abuse>harm(Memory)

3.      DPSP- neither limitation on Legi. Nor Exe.(Peak Dumbness)

4.      Fundamental Rights- protected and guaranteed by the constitution (Over thinking kills)

5.      Preamble provides both equality of opportunity and status

6.      Gandhian Principles(read the question Idiot)

7.      Fundamental Duties- not correlative to legal duties(no legislative process)

8.      Govt. does interfere in religious matters for rooting out social evils(Sati, bigamy, temple entry etc.)

9.      Mandamus to public officenotprivate person(focus on every word written)

10.  Negative Liberty-'freedom from' constraints

Positive liberty - 'freedom to' achieve your goals and live life as you want.

11.  No Law= No Liberty(PYQ h YaarL)

12.  Adult Franchise= Equal Rights not freedom of choice

13.  Liberty- Opportunity to develop fully(again PYQ)

Use the Gyan you have!

Read the questions properly.

Please clear these doubts:

1. Right to vote and get elected ? Legal or constitutional

2. Article 16 provides for equality of opportunity in matters of employment. Is it correct or public employment needs to be mentioned?

3. Q26: How is refusing to give any other job to some caste groups a form of untouchability ?

Please clarify.

@Patrick_jane What's Methadology for deciding cut off?
Is it possible to do on raw data of each test to predict the cut off for test. Irrespective of cut off 70 decided by Forumias as benchmark of Top performance?

@Wings_Of_Fire cutoff formula for the sheet is =0.75*(ROUND(AVERAGE(LARGE(I5:I935,{1,2,3})),2))

The cutoff methodology of the sheet is subjective I used the above formula based on the assumption that UPSC selects 12.5 * vacancy to mains.

So I used 75% of( top 3 candidates average ).

(I guess that was my thought back then)

Actually the sheet was created 2 yrs back & have forgotten the rationality behind it.

(I'm very bad at technical (even basic ) stuff) 🥲😅.

Learnings
1) Appointment related provisions are way too confusing , revise them at least 10 times before exam. Ad Hoc, retired , transfer

2) Did Custodian question wrong , Should be ashamed. Custodian #P or SC?

3)no monetary limit exists in applying civil cases in the Supreme Court.

4)  HC for 2 or more states | 7CAA

5)  judicial office in the territory of India for 10 years =judge in any of the state Subordinate Court

6) The constitution has explicitly endowed the power of judicial review on the Judiciary. Yes/No?

Note to self:

Silly Mistakes- not reading the word "not",

lacking conceptual clarity on subordinate courts, SATs vs normal Tribunals, PIL is b/o pow's in 32 and 226, NCW is quasi judicial, produce b4 magistrate in 24h not 48

Patrick_jane,

1.      Complainant(Individual) and State are not same.

2.      SC allows petitions only in English.

3.      Judicial Restraint protects Independence of Judiciary- disallows judges to act as legislators or executive.

4.      Jurisdiction of HC- co-terminus with state territory, outside that is extended by parliament.

5.      Judicial Review not given explicitly, but Art. 32 is. Hence, the role of judiciary in protection of fundamental rights.

6.      All senior citizens are not eligible for NALSA benefits(state govt. make rules)

7.      Amendment to LSAA, 1987 provides for Permanent Lok Adalat, Hence, right.

8.      National Commission for Women- statutory & quasi-judicial body

9.      High court- has power to review own judgment, court of record(Obvious)

10.  Constitution does not provide for Collegium- Court evolved this and there is no fixed tenure of judges, only thing given is age.

Total no. of correct answers : 33

Total no. of wrong answers : 11

Total no. of Unanswered Questions : 6

Total no. of Questions : 50

Learnings:

1. Revise properly with clarity on each and every word

2. Focus on directive words

3. NCW is a quasi judicial body

4. Re-read chapter on Tribunals and Sub-ordinate courts

Very poor performance! :(

1)Senators are directly elected .

2) What is the meaning of constituent powers of both houses of Parliament?

3)Overthinking:  If the Union Parliament wishes toremove a matter from the State list(over which only the State Legislature can make law) to either the Union List or Concurrent List in the interest of the nation, theapproval of the Rajya Sabha is necessary.

4) state councilDOES NOTreflect the federal element ! [& ULB representation is not federal]

5) Minister : chair of Consultative committee | Ministry of Parliamentary Affairs.
