I have a doubt, if someone can help :
Can the settlement of boundary dispute with another country be done via executive action ?
Explanation says that in 1969 SC held that boundary disputes could be settled by executive action as it does not involve any cession of territory.
However, #1, how does solving boundary dispute not involve cession of territory ?Won't enclaves be exchanged ?
Constitution (100th Amendment) Act, 2015 1. An Act further to amend the Constitution of India to give effect to the acquiring of territories by India and transfer of certain territories to Bangladesh in pursuance of the agreement and its protocol entered into between the Governments of India and Bangladesh.
And, #2, a CAA was required here !

Resolving a boundary dispute may not always involve cessation of territory.. It can also involve acquiring of territories only. For instance today India and Nepal have a boundary dispute over Kalapani.. If some day Nepal gives up the claim over the disputed land, the boundary issue will be resolved and in that case ,I don't see the point of constitutional amendment .

The 1969 judgement was in the context of Sir Creek dispute b/w India and Pakistan which was adjudicated by an int'l tribunal. In this, the court held that since the said boundary was disputed, it did not belong to anyone and hence no cessation of territory will take place in it's resolution.
In 100th C.A.A., exhange of enclaves took place and hence land which was constitutionally part of India was given to Bangladesh(cession) and hence constitutional amendment was necessitated. To make it clearer, in the same Land Boundary Agreement with Bangladesh, there was demarcation of a stretch of undemarcated border which happened via executive action(and not Const. Amd).
In short, if boundary is not settled or demarcated, it could be done via executive action. If the boundary is constitutionally recognised by India, then it requires C.A.

Answer is correct. How is 1st statement right? The MPA bill does not specify any tariff setting body.

Each major port is going to have its own authority - board of major port authority which are going to have powers for fixation of rates for assests and services. If we don't include this function then you think why the board would be created? and If there is no authority to fix then how it would be managed.

Yes, You are right about someone has to fix tariff. Earlier it was the Tariff Authority that has been removed. Precisely for this reason, statement 1 should have been correct a/c to me ('No designated authority to fix tariff').

The Board is the designated authority. It's provided in the Act itself.
