Sir, while nominating 2 people in upper house of state by governer, whether he have to ask recommendation from prime minister and whether that recommendation is binding on him or he have sole authority to nominate?
Upper house of state- Legislative council. certain qualified members (art,science,literature, cooperative work, social service etc.) are nominated by governor. He can’t act in his discretion but nominate those recommended by state cabinet. the recommendation of the state cabinet is binding on him. It’s apparent by the constitutional crisis in Maharashtra where the cabinet is pushing governor to nominate Udhav thackary to LC

Article 163(1): It says that the Governor must follow recommendations of the Council of Ministers in all situations except insofar as he is by or under this Constitution required to exercise his functions or any of them at his discretion.
in reference to the Thackeray, governor has “no other option” but to nominate Thackeray, as he is bound by the cabinet’s recommendation. and this is not “governor’s quota”, and is a requirement laid down by the Constitution. (print article) this far is what i understood.

I’m confused man. Ac to article you have mentioned it Should be like this but ac to the hindu article it’s clearly saying pm decision will be final. I think its clear politics. Real power of governer never works in real life. They have to ask pm and do accordingly to them. Thanks btw. ?
Article 163(1) in The Constitution Of India says “There shall be a council of Ministers with the chief Minister at the head to aid and advise the Governor in the exercise of his functions, except in so far as he is by or under this constitution required to exercise his functions or any of them in his discretion”
So the governor generally has to act on advice of state CoM led by CM.
