The power of the CJI is primarily derived from the Article 145 of the Indian Constitution. Although a convention has been established that the CJI will be the Master of the Roster, ultimately the Constitution gives administrative power to all the SC judges including the CJI to be the Master of the Roster. The power is an inherent and implied function of the CJI’s role as the Supreme Court’s administrative head, which is based on constitutional provisions.
Further, In the Supreme Court’s 2018 judgment in the case of “Asok Pande v. Supreme Court of India”, the bench responded to a challenge to the CJI’s power to assign cases to different benches, which some argued was not explicitly provided for in the Constitution. The bench’s finding was that while the Constitution does not explicitly state that the CJI is the “Master of the Roster,” this power is implied from the CJI’s role as the administrative head of the court and the fact that the Constitution vests the power of judicial administration in the Supreme Court as a whole.
