Statement 1 is incorrect: Part IX of the constitution was introduced by the 73rd Constitutional Amendment Act, 1992. The provisions of this Part are applicable to the Union territories. But the President may direct that they would apply to a Union territory subject to such exceptions and modifications as he/she may specify.
Statement 2 is incorrect: It is the Parliament (not President), that decides which provisions and with what modifications are applicable to Scheduled Areas. It is in pursuance to this power, that the Parliament enacted the Panchayat (Extension to Scheduled Areas) Act, 1996 (PESA).
