News: The President has appointed Justice Sanjiv Khanna to be the Chief Justice of India, with effect from November 11, 2014, by exercising powers conferred by Clause(2) of Article 124 of the Constitution.

1. The Chief Justice of India and the other judges of the Supreme Court are appointed by the President by exercising powers conferred by Clause (2) of Article 124.

2. The Convention is that the outgoing CJI recommends the name of senior most Supreme Court judge to the Union Law Ministry as his successor.

3. The recommendation is forwarded by the Law Ministry to the Prime Minister, who, in turn, advises the President.

4. In the Second Judges Case (1993), the Supreme Court had ruled that only the senior most judge of the Supreme Court be appointed to the office of the Chief Justice of India.
