In the landmark Judgement of K.S. Puttasawamy Vs. Union of India(2017) case which hold that the Right to Privacy is a fundamental Right protected under Article 14, 19 and 21.
Recently There was a case of snooping of Whatsapp by Israeli Spyware named ‘Pegasus’ that show personal privacy breach. Along With that Social Media like Facebook, Twitter have a very easy norms to opening account so these account have no credibility and people spread the fake news knowingly or unknowingly with using the multiple account with no accountability of the person who is using the social sites. There is even no tracing the actual originator of the content whatever is spreading on the web. Using this opportunities most of the political parties even spread their agenda and do the campaign, share the fake news and manipulate the polls and in the absence of regulatory law election commission has no control over it.
Problem in Linking Social Media to Aadhar Card: –
On the positive side, Linking of Social media with aadhar card can provide accountability, credibility and traceability of the originator of the content but there are so many problems with Linking Aadhar card with social media. these are: –
  1. In the Aadhar Act, it’s only allowed that linking of Unique Personal Identity number only for schemes and subsidy funded out from Consolidated Fund of India.
  2. In the absence of Operational data Protection and Localisation it can be counterproductive. Instead of solving the problem it can lead to further more problem creating with leakage of Aadhar data in the market and with access to hundred of million of people’s data used by social sites.
  3. More or less it will create more avenues for data security breach.
Way Forward: –

  1. Government should not shy on their responsibility about national security and privacy of individual instead of linking Social sites with aadhar it should focus on provide regulatory Guidelines to Intermediaries.
  2. It is to be ensured that these mass communication and social media apps play their rolls without compromising civil and privacy rights or national security.
