1) Examine the principles of equality and equitability in criminal law reform. How do the proposed Bills address the disparities in access to justice between different social classes?

The new Bharatiya Nayaya Sanhita Bill(2023) aims to reform the existing Indian Penal Code, the 163 year old criminal code of India.
The need for change for the existing IPC are-
1. colonial era ,old and not suitable to the dynamics of society today
2. a system of punishment not justice
3. lack of new crimes and technological incorporation

Notable features of proposed bills –
1. Abolition of Sedition law- the existing sedition law of the colonial times is abolished. Instead proper definitions of act that threaten the integrity, sovereignty and security of the country listed – separatist, secession, terrorism
2. Inclusion of capital punishment, life imprisonment for mob lynching
3. Digital transformation ,ease of legal proceedings and speedy courts
4. Separate code for terrorism
5. Punishment for organised crimes (cyber crime, economic crimes, kidnapping) and community service(theft, vandalism)

Political and Social Implications that transform the equality and equitability in criminal reform-
Political Accountability: The bills emphasize that individuals with political influence will not escape legal consequences, thereby promoting fairness and equality.
Public Safety: Stricter laws on mob lynching and sexual violence underscore the government’s commitment to ensuring public safety and protecting vulnerable groups.
Legal Efficacy: The bills aim to elevate India’s conviction rate by introducing forensic evidence collection standards and expediting trial proceedings.

The major concern for achieving equality and equitability in criminal law reform-
1.access to social justice, court to everyone- Still the marginalised communities, poor and socially economically marginalised are far away from getting the equal justice due to resource constraints
2. Fair and fast trial – justice delayed is justice denied
3. Sensitisation of victims and rehabilitation

Conclusion-
These reforms, driven by the government’s commitment to transparency, accountability, and justice, hold the potential to reshape legal proceedings, empower victims, and ensure a more equitable legal environment.
