1) Making copyright infringement a cognisable offence under the CrPC. will impinge on civil liberties, impede the ease of business and suppress free speech. Discuss
2) What is a ‘bad bank’? What are the pros and cons of setting up a bad bank?





Ans 1. In terms of content, 3 points could have been elaborated more:
First, there is a distinction between copyright infringement and copyright piracy. These two types of actions must be distinguished.
Second, the law is complex and it is very difficult to establish originality vis-a-vis infringement. Investigating officers lack skills to understand the complex issues which are difficult even for lawyers, given the ambiguity.
Third, since the offence is non-bailable, it means that on complaint the person might be incarcerated in jail, while the case remains under adjudication. So collectively this will impact freedom of expression.
Similarly, highlight this might impact commercial activities in entertainment and publishing industry due to litigation.

Some more points could have been added in pros of Bad Banks
1. Quicker resolution if all bad assets are under single entity.
2. Addresses the loopholes of ARC model, pvt. entities are not efficient based on global experience.
3. Domain Expertise: A bad bank run by professionals with domain expertise in resolution.
Also, in the introduction, You could have mentioned some data about the level of NPAs at present. Try to add some schematics in the answer.
Facts/figures will help distinguish Your answers from the generic answers and get extra credit.
